constant building work, even on weekends? What can I do about it.

okay, I live in a ground floor two bed flat, my upstairs neighbour has for almost ten months been doing constant building work, I have spoken to my housing and they have told me there is nothing they can do, I even spoke to him and he was not nice when telling me he could do "what ever the F* he wanted in his flat" even though he has never asked for permission from the housing to do any of the work. He does not own the flat, its rented from a housing association. He removed a bathroom with out permission, the housing are now aware of that, but the noise continues even on weekends and I have to live below it, please is there anything or any one I can speak to about getting ether it stopped or at least told when this nightmare will end.

Talk to your neighbour? He's best placed to tell you when it will end.

I have already hes not the nicest of people , his response was "I can do the fuck I want in my flat" :(

Sorry to hear that, but he is right. So long as he is not doing it at antisocial hours, your councils website will tell you what those are in your area.

so what your saying is I'm stuck, I have no option but to live under a building site like some invisible person? there is absolutely nothing? :( :(

There are time limits they can't breach, check with your council. It's something like no work before 7am or after a certain time. Only on Sat mornings so Sat afternoons and all day Sunday not allowed.

Keep a log of dates and times of all incidents, and ideally record the noise on a mobile phone. That then gives you 'evidence' to present to the council.

well its Sunday today, and the have been here all day and yesterday till 4:30 I am keeping track of the days there coming and I believe they are cowboy builders as there's no company name on the white van they use.

no, but they have been working all week, every day, including Saturday and Sunday. Today they didn't leave until at 6pm. Who works all, those days every week for ten months, any one with a family would want some days with them, I can understand wanting to earn money but this is ridiculous, I'm not blaming the workers, they are just doing a job. But my upstairs Neighbour never once said when this will stop, and each time he did say this would be the last, it just continued on, I feel physically sick and shaky now because of all the noise. 😢

I did sympathise at first and tbh I still do because I imagine the noise is not very nice to live under but you’re coming across absolutely ridiculous now. Claiming they are cowboys because their van isn’t sign written and because they are working everyday all day. And the family comment 🤦‍♀️ yes people with a family would like to spend time with them but work is work it needs doing and money needs earning to help provide for said family (if they have one). Surely if they’ve been going for 10 months the work can’t take much longer.

Who did you speak to after the housing association? If you haven't already could you leave a message for your housing officer to ring you? This sounds very strange how can a HA tenant afford 10 months of building work usually just two days would cost a grand.

Yes it does sound strange but could have been a bank loan, He originally said he was going to buy his flat, but the HA said they wanted over 80,000 for it and he said it was too much,

Then he lost his original job. yes we use to talk before all this and I thought this was my last move. Then as of April when he lost his job, his religion, he was part of Jehovah witness but was kicked out, I don't know why and never asked plus his girlfriend at the time also a Jehovah Witness left him, all this started, but he as far as I know has another job and the work is done while he's out.

I spoke with my rent officer over this but was told that between 9am and 10pm I could do nothing. I am going to talk again to the rent officer again and this time I am going to put in a formal complaint about it. Along with going to my doctors to be put back on my anxiety meds that I thought I would never use again.

It must be a really big flat or they are doing some serious renovations for it to take 10 months/ 7 days a week ??? How many rooms has the flat got ?? 20 ?

If you think they’re creating a noise nuisance, keep a detailed diary and submit it to your council’s environmental department.

There are guidelines about ‘noisy works’ and the hours they should take place, but this generally applies to construction works and not noise from DIY.

Every social housing address has a housing officer OP and you should be able to arrange for them to call you through the HA

Lodge a complaint with the housing association about their lack of action. Don't let them fob you off. Just keep escalating this.

He does not own the flat and does not have the legal right to do major works to it.

I am surprised that the HA is not concerned that he is trashing the flat with his building work...

Your local council should have details of when building works are allowed.

I would record it and get in contact with your local MP. Find all of the tenancy rules that he is breaking and send them with the recording.

I can't stand dreadful people like this. The obsession with power tools 7 days a week in this country is a nightmare. Sorry you're dealing with one of these idiots!

Check with the council. My council you can't do noisy works after 1pm on Sat and not on Sunday I think. And you can report them to the noise dept if they do. You can also contact building control if you think the works are major and require a cert
