Hi guys

Just after some more advice (see previous thread re the full story- I'll keep this short).

I have served tenants a s21. They were due to move out in 9th March- they didn't. Started court process. The first stage was completed and they had 6th June until they moved. They didn't. I've now applied for Order for possession which I'm waiting for a date with the bailiffs details.

Today I have had an informal notice from the council to improve 2 things. 1. They state there's damp in the back room downstairs. 2. Loose floorboard upstairs so it's a trip hazard. Neither issue was reported to me or the letting agency. Letting agency have confirmed this is the first they've heard of this issue. Seems maybe they're trying to invalidate the Section 21. Is this now invalidated with the informal notice? Surley they'd contact me or the letting agency first and if we didn't repair then they'd go to environmental health? I didn't even know environmental health were going out! Just recieved the letter today.
Absolutely fuming! They have continued to state they don't want to leave the home so they're trying to buy time.

Any advice appreciated. My FIL also passes on Sunday and this has added so much stress with the funeral tomorrow!

I have a solicitor and a letting agency so no diy here. I just recieved the informal notice at 6pm today so can't discuss with the solicitor until tomorrow and it's just been stressing me out all evening!

Sorry about the loss of your Father in law

It's good that the agency will confirm the issues have not been reported before

Email the solicitor now and outline the situation so you feel you have done what you can, they can reply tomorrow

You really can't do much tonight except try to sleep. I hope the funeral goes as well as possible Flowers

I too am really sorry to hear about your FIL & hope that tomorrow goes as well as these things can.

im confused. WTAF does either issue have to do with them, they're not supposed to be there!!

I hope you get them out soon.

I agree- I think they're just trying to invalidate the eviction process. I'll try speak to the solicitor and council today!
