Buyer has entered property pre exchange and started renovation

We were supposed to exchnage last week, then yesterday, now the proposal is exchange and complete tomorrow, all delays on buyers side told its mortgage company releasing fund.

property was vacated last week, but I removed the last items yesterday. Went back this evening to do a meter reading. Garden dug up, carpets ripped out, all windows open, lights on.

I am so shocked I have no idea what to do now …technically is burglary … but if this sale falls through I have a much less saleable house …

and before you ask how has he got in, there was a lockbox with keys in that the estate agents have been using … so either they’ve shared the code with him or he’s watched them and then let himself in.

I would be taking that equipment. Even if just to prove the point. If it’s not on the sale manifest of things included in the house then it shouldn’t be left in the house…

Did you miss that they are planning to exchange and complete tomorrow? All being well the garage will belong to the CFs tomorrow. It's only a problem if they pull out or there is further delay.

If it doesn’t go through presumably the trespassing and damage to another’s property case is so black and white that they will be before a court.

In reality what's the problem if they complete tomorrow and no acts of god happen overnight? Yes it's outrageous and risky but hopefully not likely to actually cause any serious issue!

I don't mean to worry you but email the solicitor immediately with what you've found. You don't want them pulling a fast one saying that they don't want to pay the same amount because the carpets have gone etc. you have no proof it's them.

Absolute fuckery that is! I can't believe someone would do it.

I wouldn’t jeopardise completing tomorrow but I’d be furious.

Fingers crossed and assuming completion is tomorrow I would save your rage for the EA and go absolutely ballistic. And then get a whopping discount off their fee. Be sure to instruct your solicitor NOT to pay their invoice. They're normally speedy at getting them issued once an exchange goes through. Perhaps post on legal for advice because you don't want to end up in breach of contract, but ideally haul them over the coals for this. It's outrageous.

I emailed them straight away too. They negotiated a price reduction when they saw the state of the carpets without furniture last week!

Why? Negotiating the price was obviously because they deemed the carpet unfit so negotiated the cost of replacing them. So of course they ripped them out, that’s why they got a discount. To pay for new ones. Pretty normal when selling a house that they’ll negotiate for stuff that will cost money to fix.

I personally wouldn’t have given money off for carpets since those would usually get replaced anyway but the OP did so that’s that.
