The previous thread is almost full! We've had lots of completions, exchanges, offers accepted, maddening conveyancing teams, strange requests, and worries to last a lifetime. Welcome welcome.

My update is that everything seems to be lining up and we're looking at exchange next week. 🤞 Hoping to complete a few weeks after that.

Update - my blood pressure has skyrocketed.

One of the parties fuckwits further up the chain let it be known early this afternoon that their mortgage expires on Wednesday next week. And they can’t extend it. And can we exchange tomorrow morning?!

Well no we can’t because the AML checks aren’t done and my immediate vendors solicitor hasn’t come back with all the enquiries. See also some things have to actually be in hard copy and witnessed and the earliest I can get them in the post (given I didn’t receive them until half past four this afternoon) is tomorrow. Also funny enough, it’s not that simple to move a large sum of money.

I’m absolutely fucking livid - who leaves it this late to point out their mortgage deal expiry?!

I’ve just had a flurry of sending my conveyancer every bank statement/investment statement etc I can get my hands on in a fit of absolute panic rage. It’s too late to even call my bank to arrange the fund transfer. Which I also can’t do until they’ve done the AML check. *screaming.

Your solicitor should've done the AML checks as soon as you instructed them, @TiredCatLady, so that's on them.

Has anyone had any experience with restrictive covenants? We have one on the property we want to buy stating that no extension or building works can take place without the permission of a man who wrote the covenant in 1929 (unless he was 1 when he wrote it I’m guessing he’s not around anymore!)

That's an odd one! Surely if you did building work anyway, then the only person who would have an issue with it is the dead man??

@NoWordForFluffy Offer accepted 7th May, I only instructed them on 8th May! But yes they’ve dragged their heels with that one despite me asking repeatedly if they need further information from me.
Just got documents witnessed and trying to sort getting them to the solicitor before COB tomorrow.

@TiredCatLady, I think it was exceptionally optimistic of the mortgage expiry person to think it could all conclude next week.

What's gone on with the chain though? I can't remember. Because it's clearly been going for some time if mortgage offers are running out.

TL/DR - ignore this covenant, it wont cause you any issues. IANAL

If the covenant says you need to get permission from him it means that he put the covenant on. Covenants can only be challenged by those who put them on but sometimes it covers heirs and successors so it depends on the actual wording.

I would assume he will be long dead so you can do what you want as he wont be around to enforce it anymore. It may become an issue when you sell but an indemnity will cover it for a hundred quid or so.

I am not a lawyer but I'm sure your solicitor will agree with me that it will likely be unenforceable, but you may end up with a solicitor like mine who argued that an informally exonerated covenant after someones death in the early 1900's needed the seller to get an indemnity as it was never formally exonerated 🙄

@NoWordForFluffy chain of four was originally completed at start of April, sale of house I’m going for at the bottom fell through, hence I jumped on it (had wanted it previously). I really don’t understand why the link in question didn’t pre empt this being an issue as they must have known how long their mortgage offer was valid for?

That was my thinking as well - I thought it was 3-6 months usually.

If their offer expires, will the whole chain collapse or will they be able to try and get another one?

@fromtheshires i wasn’t planning on grave digging to get an agreement for a kitchen extension so i think I’ll take my chances! Thanks for replying glad someone else has come across this!

Climbing onto the thread as just starting the process of selling, to downsize. Not seen anything close to what I’d like in the area which I’d like to move to, and can’t mentally cope with a massive chain where I have to sell AND buy so will rent for a year. Just had draft brochure from the estate agents and really not happy with the photos. I chose them due to success rate in the area but didn’t expect a 24 year-old to rock up with an iPhone when the other valuers were offering professional photos for £200 extra…is this normal? The photos are take from so high it looks like he’s been using a selfie stick.

I really think you should go grave digging, just to be on the safe side. You never know, he may object and haunt the extension forever!

A basic DSLR (even a basic digital camera) is cheap. Id be asking the agent to come back round and take photos on a proper camera. Theres literally no excuse other than laziness.

Unless you've gone with a purplebricks type deal - it's a bit suspect that you're asked to pay for photos! We've never paid anything upfront to an EA and photos have always been professionally done - we've found lots are using a Giraffe360 thing that takes photos and does the floor plans at the same time, even thats better than a selfie stick.

Might be an idea to look for a new agent?!

So today is moving day!!!! Wish us luck! Anyone who's seen my posts will see that we're out of our flat today and unsure if we're moving into our new house or going back to live with parents (seller of our house is an elderly lady who has had a fall and is in hospital) we've been so anxious all week. Our seller has a power of attorney so that's ok but there was the fear if the worst happened probate would have to kick in which would mean we wouldn't be able to move into our new home. So far everything is on track I've never been so nervous though in my whole life! Good luck to everyone hopefully exchanging today or completing!

@PauliesWalnuts we have just downsized. We completed on our sale on the 28th May. Currently living with my parents until we can complete on our purchase (hoping for mid July).

We moved from a large 3 storey 4 bed/3 bath townhouse and are going into a small 3 bed semi.

I sold and gave away so much furniture and aren't even sure if the furniture we have will fit in the new house until we actually move.

I think our local charity shop is stocked with 30% of our belongings and clothes.

Good luck. Downsizing is definitely a learning curve.
