Last minute delay for completion nightmare

We are supposed to be completing today but our lawyers IT system is completely down and they have been unable to transfer the money. Has anyone experienced something similar and what happened next? Our sellers just rung us panicking as they have had all their stuff packed up and we have loads to deliveries booked to the new house tomorrow (whiteware, furniture etc). We are bottom of the chain - will be liable for everyone’s costs even if it’s our lawyers fault?

Contracts exchanged today. Moving Monday.

Just coming on to say that this is actually part of an international incident. My friend in America was supposed to complete - known as ‘closing’ there - on Monday 27/11. But all of the large US title companies were victims of hacking or hacking attempts over the period 23/11-25/11. She was lucky: her closing was delayed by only one day and deposit of funds by two days. The situation in America seems to be returning to normal more quickly, possibly because they do not have chains.

Taylor Rose called me earlier. Expecting a resolution imminently but did not give a timescale. Told me they’d prioritise people with mortgages.

@anyusernamesnotused yup, if the frustration of not moving doesn't get to you, the boxes certainly will! We didn't exchange in the end yesterday, a different Solicitor in our chain was 'unavailable to exchange' whatever that means!!

Latest update from Talbots, BAU from Monday. Unfortunately I'm with Taylor Rose, hopefully they will do something similar.

I know there is a view that a cyber attack could happen to anyone and I am amazed at how little mainstream coverage there is (possibly in recognition of that?) but surely CTS is going out of business after this?

One post here says a firm has already switched IT companies and many others will be asking questions to CTS once this is resolved.

CTS seem to be in a state of flux at the moment. The CEO left at the start of November and the new CEO and a new COO don't start until the New Year. The new CEO has apparently been identified but not yet named so might not even be contractually confirmed yet.

So the Chief Tech Officer who has been there 16 years is currently answerable only to an Executive Chairman who is the Chairman filling in as CEO.

So there is barely a Board at a time of real crisis for the company.

we’ve had hints that we’ll know on Monday but our issue isn’t with either Talbots or Taylor Rose.

the annoying thing is we exchanged at the end of October and we were ready to go then but someone in the chain wanted a month in between exchange and completion. So now here we are..

@choux. I agree, I don't think the cyber attack is the issue as there are many- it's how you deal with it and communicate and how quickly things get back to normal. I'm not saying it's easy, but I think everyone can agree this particular issue with CTS has not been handled well

@LynBin100 I know - they didn’t say until we were ready to exchange either. In fairness, I think there was a genuine reason behind it but that wasn’t communicated to us until very recently.

you can imagine how frustrated we are. We’ve been living out of boxes for months.

I’ve changed the solicitor on mine so it can get finalised. My offer expires soon and I’m not taking any chances waiting. Especially with Christmas and new year right around the corner

if you change solicitors now, don't they have to re-do all the work and with the festive seasons around the corner, how long will they take? Setfords can't give us any timescale on how long it takes for them to restore our files. It's impossible to make decision without knowing how long do we have to wait

Email from my TR case handler when I asked if there's any update and whether there's any plan to implement a back-up solution like Talbots and ONP appear to have done

"Good morning,

There is no further update as our systems are not back online yet. We expect this to be resolved soon.

Unfortunately, there are no back-up systems in place so we have to wait for the third-party provider to restore access.
