Last minute delay for completion nightmare

We are supposed to be completing today but our lawyers IT system is completely down and they have been unable to transfer the money. Has anyone experienced something similar and what happened next? Our sellers just rung us panicking as they have had all their stuff packed up and we have loads to deliveries booked to the new house tomorrow (whiteware, furniture etc). We are bottom of the chain - will be liable for everyone’s costs even if it’s our lawyers fault?

Has anyone had any update from Talbots Law? Thought they were moving along, but back to same message yesterday - no exchange due to IT problems :-(

Just so terrible that different people are receiving different responses, from the same branch! They either have a manual solution or they don’t. And understandable to prioritise certain cases over others, but they should be more transparent. Why they have not taken ownership of the situation and sent out updates to impacted clients every day to avoid all the incoming questions is beyond me!

Absolutely this!! TR have been useless. It wasn't even them that told me about the issue - I got a call from Nationwide on Wednesday last week to say it wouldn't be happening on Friday. That was the first I heard about the issue.

Ours is a remortgage, which I fully appreciate is a fraction of the stress and tangled logistics of a house move. But I wish they'd just say something about what's going on, where they've got to, whether anything is moving, just anything at all! The lack of any communication is so frustrating.

TR have today told me that their IT department things things will be back online by Friday but there are no guarantee's - personally I don’t think I will be online any time soon and we are loosing money every day this goes on.
Our case handler wasn’t even apologetic or sincere - just treating it like a minor annoyance. Just unbelievable

Ok. Fyi I haven't exchanged today. There is a problem with funds in the chain being returned to a lender last Friday so they need to be requested again.

Rather hilariously though, TR are now chasing that buyers Solicitor for an update as they are ready to exchange!

I don't think do. They seem to have a lot of offices. The people I've dealt with haven't been great though, even before all this.

Could you share who your contacts are at TR? I was informed today that they still can’t do anything until they have access. Seems to be one story for one client, and another story for another.

I have no contacts at TR. sorry. the flat that I'm buying - he is using TR but I have no direct contact with the vendor. I'm in a chain of 6 but only get updates either from estate agents I sold through or bought from or my Solicitor (Chartered Legal Executive) - she is not a case worker or a conveyancer per se, which is why I call her my Solicitor. I honestly think my issues at the moment are with the length of the chain and due to the CTR delays and trying to get all the ducks in a row. The flow of funds seems an issue, but hey, maybe tomorrow it will be another issue. Obviously, I'm not at the bottom of the chain, so I haven't paid any money out but I know my buyers paid their deposit about 20 November! They must be spitting feathers.

Oh I see! Apologies. Being in a chain must make it even more difficult to manage! Such a tricky and unfortunate situation. We are lucky in that we sold our previous home in September and are now in a temporary rental. It was stressful at the time but I am now glad our delay is only having a knock-on impact on our purchase, not a wider group. Fingers crossed for you.

@alicefenton88 no problem honestly, I don't expect everyone to remember my story - we've all been here a good few days now. Hence my question earlier about remote workers. I'm pretty sure some TR people can't help because they aren't Solicitors. They don't have control over anything. If the computer says no, they don't know what to do.

I’ve had a stupidly unnecessarily stressful day today too.

I think we are completing on Friday but didn’t get confirmation from my solicitor as it hadn’t reached him by the end of today (top of the chain took ages to come back). It had reached my sellers solicitor and I know my buyer is happy to go ahead, so due to potentially losing my removals I’ve had to bite the bullet and pay for them. I won’t know until the morning whether that was the right decision.

it’s all so stressful. I really hope you manage to get your exchange through tomorrow.

@anyusernamesnotused it's dreadful for everyone. I SO hope you complete on Friday. I really do Xx Sometimes we just need a leap of faith and go for it. Even if I do exchange whenever... I'm still going to have sleepless nights thinking about the whole chain and whether it will complete on the allocated day.

In other news, an EE mini hub (after BT cut you off) takes 4 hours to charge, from receipt, but once it's working - it's blindingly fast. Well, for one person anyway Wink

I agree. I think it’s a quantity over quality approach at TR sadly. Very few of the people I speak to regularly there have solicitor in their title.

Although I have to say, aside from recent issues our team have been good there, but they are much cheaper than previous more traditional legal firms we’ve used.

@LinL ask then for the complaints contact at head office (we did) as you need to start the process whilst things are happening. Ask them to confirm that as a branch they don’t have any paper / hard copies on file, and to confirm that that is the only reason exchange (without risk) is not possible as they have an approved case management system up and running so otherwise should be able to, other branches are currently doing. I suspect they have a list to get through and are prioritising cases so get your shouty big girl pants on don’t let them swerve this ! Ooooohhh sooo angry on your behalf, get on that phone and don’t get off till they commit to do something urgently and this week!! 😡

Thanks for the encouragement and support! We pushed back hard today and finally they agreed that we won't have to waive our rights and has now asked for the funds from our lender and aim for completion next week! :)

So we have got written confirmation of funds from lender ( which was the slight squeaky bum on exchanging ) so all lined up to complete Friday - can’t actually believe it yet . It’s been 6 months since we 1st accepted and offer and a total nightmare so here’s hoping x

@anyusernamesnotused this is a top tip re EE thingy - found out today that our BT is cut off cause buyers provider contacted them and told us them we were moving last Friday 🤦🏻‍♀️ I’m going to get me one of these as no internet possible in new place for 2 weeks due to the current kerfuffle and not knowing when we were moving . Thanks !

@CBcats well done for pushing back. I’m so pleased you got a result from it. iI’f like to take credit for the EE Hub but it was@LynBin100 that recommended it. I’m working from a 4G dongle which is okay but not great. I just couldn’t face calling my internet provider and explaining yet again!

Latest from TR for us is that they can’t proceed as they’re unable to access the lender portal until they are back on the old system.

They are unable to confirm when this will be but ‘good progress is being made’.
