Whose responsibility to remove asbestos?

We are planning an extension that will join onto our neighbour’s extension. On her wall there is a flue and extraction vent that faces into our garden.
She has agreed to remove them as she was due a boiler renewal anyway but has just found out the flue is asbestos and now going to leave it rather than pay for asbestos removal.
Is it her duty to remove it or ours, since we’re the ones who need it removed to progress with our works?

Can anyone offer advice or point me in the direction on where I can get guidance please?

These is no requirement to remove asbestos in situ that is not causing a health issue.

I'd say its down to you and certainly as she seems to be doing you a favor? Unless you can show she has no right to have the extractor exiting your property - but this must have been there a good while so you're unlikely to get an ywhere with that.

Fair enough, I thought it might be down to us as the remaining external bit doesn’t affect her now her internal bit is sorted

Move your extension in a bit so it isn't touching your neighbours. Otherwise if you want it removed and she is amenable to that then it is down to you to pay for it. You are probably looking at 1-3k for a proper abatement of the asbestos.

Yes her pipe is on her wall so goes beyond the boundary and can only be accessed from our garden
