Does my neighbour need a party wall agreement? Work already begun

Hi, looking for some advice!

Mid-terrace, nextdoor has been bought by a landlord living in another city. Builders arrived a few weeks ago and are ripping everything back to brick, changing the stairs to the loft conversion, new electrics, plumbing, the works. No problem, the house was tatty and needed updating - all fine (although some notice probably would have been neighbourly...). The cellar/basement was a (poorly converted) room, they've ripped all that out too. They've filled two skips with rubble/bricks/clay and have told me that they're digging down 'slightly' i.e. removing the concrete and 'a bit more' because the height of the original room doesn't meet regs. Should they have a party wall agreement since they're digging near our foundations...? Does this count as 'excavation works'?

Any advice would be greatly received - I'm expecting a call from the owner to 'let me know exactly what work they're doing' later today..

It’s cheaper to try and get away with it.
You can insist on a surveyor and they have to pay
