Unfurnished house: washing machine on inventory

I rent an unfurnished house. The lease states that the landlord is not liable to repair or replace any appliances in the house. The landlord told us that no washing machine is included.

When viewing there was a washing machine. When we moved in the washing machine was still there. The washing machine was listed on the inventory.

If the machine broke, who is liable?

Has a tenant left it behind? You need to clarify with the landlord if they do own it or not? If they don’t, and you want to keep it, just use it? If they do own it, then seek clarification on responsibility for it.

Generally a LL will be responsible for any appliance repairs such as a boiler or built in appliances. So I think you need to clarify who owns the washing machine. Then decide if you actually want it if it’s theirs but you are responsible for it. Would you prefer your own washing machine?

If it breaks and the landlord refuses to fix or replace, do you have somewhere to store it and the ability to get your own? If so, you can use your own and just return it when you vacate.

If not, it is best to get clarification from Landlord in writing ASAP.

In practice, this is quite a common clause in the lease, but many landlords will maintain or replace a faulty washer if they provided it.
