i am selling my flat. I lived here for 15 years. Buyers are cash and I am selling chain free. It’s been 8 weeks ago I accepted their offer. We are both motivated for a quick sale. I am moving out in 2 weeks and on a 2.5 week holiday the day after I move. So can’t do anything.
all was progressing well and quickly until I found out my lease had been incorrect for 15 years. Apparently there was no safeguard for insurance. Such as cover stating we needed to each have building insurance. They new buyers want the lease changed it an indemnity policy paid for by me. Fine I will pay this to love sale forward.
Also turns out that I own the freehold for upstairs and they own mine. Was not aware as the developer was listed as the landlord. I pay not ground rent and was told it was a peppercorn lease. The paperwork wasn’t done correctly. Plus, The flat above me sold last year and their solicitor didn’t complete the paperwork to transfer new owner to my freehold owner. So it’s still in the old owners name. This needs corrected.
I have been told this will take time to correct as land registry needs to be involved. The old owner was a conveyance solicitor. My solicitor said at least they are not charging!
any idea how long this will take. It’s been 2 weeks now since the error was spotted. Solicitor has also said buyers solicitor has gone very quiet.
any advice to speed this along. I am now paying variable interest in my mortgage
