Window cracked 4 months after fitting… should they replace?

We had a double glazed unit replaced in December 2022 by cloudy 2 clear. Just the pane, not the frame. Just noticed, 4 months later, that it has cracked on the outside, picture attached (clearly not a crack due to impact, which their assessor agreed with). Their 25 year guarantee states that cracks aren’t covered unless within the first 4 weeks after fitting.

We think they should replace under the consumer rights act, which supersedes their guarantee. They are pushing back.

We have said if no resolution then we’ll take it to trading standards/consumer ombudsman. Their current stance is that the consumer rights act doesn’t apply here due to their guarantee (which I know is bollocks). They’ve said they’ll replace it for cost price. We think they should just replace.

Yes. We had this with a new window and our builder put in new glass no problem and no charge

Thanks MrsBlondie. They seem to be saying that because it didn’t happen in the first 4 weeks then it’s not a fault… Hmm
