How to reclaim a deposit from rental agency?

We let out a furnished property for 3 years. Ended tenancy in agreement with tenants who moved out with £450 rent arrears. I approached agency (Barnard Marcus) who had 'managed' it (ie claimed a % of rent each month and did nothing else) about getting full £1500 deposit back. They said I had to pay for their checkout report (rip off £150 + £60 to start process of claim). Their clerk said the property was left clean - it was not. Furniture was also left stained or torn and unusable. Tenants also kept a dog at the property which wasn't supposed to be allowed, so there were scratches and dog hair everywhere. Barnard Marcus now say TDS doesn't allow me to claim full cost for replacement furniture after 3 years - I don't think that's very long for stuff to be maintained in a reasonable condition. The tenants have also now disappeared. So, BM will retain most of my deposit (they will pay me the rent arrears), forever as far as I can see, as they won't give it to me and they can't pay absent tenants. No idea what to do.

Why won’t they give you access to the deposit protection scheme account? What you can and can’t claim is all dealt with in there and if the tenant doesn’t respond in a certain amout of time to contest it, you get what you’ve claimed for.

Of course it doesn’t, the stuff is 3 years old and it’s fair wear and tare of being used in someone’s home. But yes some money towards damaged stuff would probably be awarded.
