Selling house to buy to flats can we break chain by completing on one flat before the other?

Just that really. H & I have separated but still living together (with two dc) while the sale and purchases are going through and it’s painfully slow! Our buyers are being very patient but I’m worried they may decide to look elsewhere if this drags on much longer (issues with wrong management pack being sent out by leaseholder but not being picked up by one particular solicitor for 6 weeks, that kind of thing) so I was wondering if my flat was ready to exchange /complete before h’s, would I be able to do that while his is still trundling along to complete at a later date? I know I could call the solicitor but I only thought of this in tne middle of the night and I can’t call them until Tuesday, impatient.com!

Do you need the sale of your house to go through before you buy the flat?

If so I don’t see how you can complete on the flat first.

If you don’t need that sale to go through first you can buy the flat anytime you want, do you have the funds available for the deposit?

Sorry I think I misunderstood - do you mean your flat will be ready but just won’t, so he’d go into rented for a while? If so I think yes you could do that and his funds just wait until he’s ready.

Do you mean could you exchange on your house and use your share of the proceeds to exchange on your flat straight away? I think as long as you’ve agreed how the equity is split I can’t saw why that would be a problem. Your ex can just put his share in savings until his flat is ready as well.

Yes of course you could. You would just need to work out with your ex where he was going to live.

Thanks all! I am buying a flat outright from the proceeds of the sale and my h will have tne remainder plus a very small mortgage for his purchase (he can stay with family or us at an absolute push) so I can give our buyers so much needed light at the end of the tunnel!I’ll give tne solicitors a call on Tuesday. Thanks again x
