Urgent help with cancellation of surveyor - what are my rights?

Hi there,

I am having an extension and I asked a surveyor to send out the party wall notice. I did not instruct him to be the appointed surveyor. Just send out the notices.

My neighbour bless her has responded to the notice by saying she appoints the surveyor to be our agreed surveyor. I of course have not instructed him.

However last night I googled the surveyor we are now having to use and he has a massively bad reputation in the industry for being a rogue trader. He has had several law suits filed against him and has been struck off RICS.

I now don't want to use him any longer and my neighbour is fine with this.

I've checked and he has stated there is a 7 day cooling off period. However I think legally I have 14 days. I am well within both as the notice only was sent out on Friday.

Firstly can I definitely cancel the contract, and what wording should both myself and neighbour use? I have paid for the notices so there is nothing owing on my side.

Thank you to anyone who responds! I'm stressing out about this massively,

If he’s saying there’s a 7 day cooling off period and you’re within that, surely you’ve done all you need to? Just ask him to confirm?

If he's been struck off RICs and has a really bad rep then surely the contract is null and void since you need him for a specific purpose that calls for being RICS certified?
