Withholding part payment due to poor service

NC for this as other posts are outing.

I’m part-way through a big renovation. I ordered new windows in Feb and was told that there was a delay on the materials so they wouldn’t be fitted until end of May. Fine.

Mid-May comes around and still no date. Eventually they tell me it will be June before they can fit due to staffing issues (I checked this out and it’s true). Ok.

End of June comes around and after much chasing they eventually confess that due to ongoing staffing issues my windows won’t be fitted until 1 August. I’m pretty annoyed at this point as have had to rearrange other works that depend on the windows three times, including scaffolding. Other tradespeople are getting annoyed by this. However, the window company assure me that it will be 1 August and will even try to do it before that if they can.

Yesterday I received an email saying that there is a ‘major delay’ on my windows being fitted. I’ve just called them and she’s says 1 August is no longer feasible and they will get back to me with a new date.

I appreciate there is nothing I can do about this - I’ve paid a hefty deposit and I can’t switch company now anyway as it would take even longer. I’ll have to wait it out.

However, WIBU to withhold some of the final payment due to the disruption and inconvenience? Could they take me to small claims court?

I just can’t believe they’re getting away with this.
