DH has done something stupid with contract

Buying our first house. He just sent the paperwork to solicitors for exchange. We are being pressured by buyers to exchange tomorrow. Anyway, he has returned the documents but somehow he’s only returned the last pages of the mortgage contract. (The ones with our signatures) and the rest of the contract is here. The solicitors aren’t doing to accept that are they?

No but he can put it in an envelope and put in through the door by hand.

Call them and ask? Or just take the rest of the missingn documents round to them?

They don't have to be local. Just drive over there.

As an aside - always use a local solicitor (in case of just such circumstances).

They are literally the other end of the country. We got them as free conveyancing with our mortgage. But yes lesson learnt!

PDF it using your phone, email it and then bung it in the post first class

The seller has been pushing for exchange and I feel like this delay is bound to upset her even more. Ranting here so I don’t rant at DH who feels bad enough

Do you think they might accept an emailed copy of the rest of it when they have the “wet” signatures?

Scan it and email it to the solicitor so they can start checking it through and put the paper it in the post for next day delivery. They can marry up the contract with the wet signatures.

Wouldn't the solicitor have a copy of the contract on file anyway? Don't they only need your sigs?

That’s what DH thought which is why he unattached it and sent just that page. I assume they do have it on file. But also thought they’d need the whole lot?

Are there any sections of the contract on the page with the signatures? Or is it a page with only signatures on it? If the first then they may well accept it, especially if you are able to scan them a copy of an entire signed one too.

Not necessarily! It’s even possible to exchange and complete on the same day if need be.

Stupid question incoming - (can you tell the first time buyers) - DH is asking me if the pre contract report is definitely the actual contract. It’s that document he decided to massacre. He sent the other ones intact. Again whyyyyyy?!

That sounds more like the report on good title. That is the document your solicitor prepared that tells you all potentially bad things that cropped up during conveyancing. Eg there is a mains water pipe running under your land and the neighbors have the right to hold a naked solstice party on your lawn once a month and you are obligated to film it.

It is your solicitor making sure you can't say that you weren't aware of it.

It is a worry that you have signed it without reading it. It is the most important document.

The contract is drafted by the vendors solicitor and your solicitor should have drawn your attention to anything that is not straight forward (normally set out in the report of good title)

Most legal contracts require all pages together as to now do so leaves the opportunity there for them to be swapped out of changed.

It's also a good idea to initial all pages of any contract even if they don't require signing so no one can ever dispute the content at a later stage.

I read it. But I signed everything a few weeks ago. DH has been working abroad and so has only just signed his bits. I can’t remember exactly what all the different documents where. Just a worried phone call from DH has thrown everything up in the air.
Hopefully that is what it is.

It was sent in the post so I can’t reprint anything unfortunately. It will still be missing the signature page if I scan and print what we have.

Don't worry... You have plenty of time to sort it out before the 11th. As a pp said up thread you can exchange/ complete on the same day if the funds are in the escrow account.
