Apologies for the long thread!
Our deeds do not indicate ownership of the fences in our garden. When we purchased the house last year the solicitor letter said that the deeds contain no indication of who owns the boundaries so “in the absence of evidence to the contrary” assume they are party boundaries (so jointly maintained). The letter then said to “ refer where appropriate to the Sellers responses to the boundary enquiries in the Property Information
form provided. This reflects the situation in practice albeit the legal position as stated in the title deeds will most likely take priority”.
The sellers response said that we are responsible for the left fence. We have asked and this is how it is “on the street”. We fully maintain the left and our neighbours to the left believe that is correct and maintain their left fence fully.
Our brand new neighbours to the right have asked us to pay half for fence repairs. Technically this seems to be correct but their right hand neighbours fully maintain the fence between them meaning our neighbours would foot the cost for only half of one fence and we would have to fund the cost of 1 and a half fences.
Has anyone else had this? We don’t want to start asking our left hand neighbours to pay for the fence between us at it would have a knock on effect all down the street.
