Build porch on pavement

My house (owned with mortgage) is about 20 years old and we are not the original owners.

The front of our property is directly on the pavement but the pavement is 5 yards deep due to parking further down.

On the front of our property we have a large canopy (2.5 yards across, 1 yard deep give or take) that overhangs the pavement. It exceeds the boundary of our property, which appears to be the pavement edge.

However, is there anyway we could legally change it to a porch? There is ample pavement space. Don't know where to begin or who to contact!

Doubt it but contact your Council planning office.

Wouldn't it block the pavement access. The council planning dept would help.

Is the pavement adopted or privately owned?

If adopted no chance, if private possibly

How on earth do you think you can build on land that doesn’t belong to you?

Claimthepavement · 07/03/2022 20:39

Thank you I'll try council planning. I believe it is privately owned as it doesn't appear on the council map to report a problem.

I wasn't going to just build, I was going to go through all the legalities. All the other houses have the same canopy but they are set back by a yard from the pavement. Seemed odd to me that we wouldn't own the land the canopy is over when I checked the deeds.

Is it a right of way, a public footpath. Do people walk on it.

You probably need to look into flying freeholds - that’s where a part of a building that you own overhangs land belonging to someone else.

It doesn’t matter what it is. It doesn’t belong to you
