Hi everyone,

We've been to view a house today, and it's in probate. The owner has "not long" passed away (according to EA) and probate has not yet been filed. The EA is suggesting probate will be done in 8 weeks.

Does anyone have any experience of this? Google says probate takes upwards of 6 months: is the EA spinning a line?

There was quite a hold up in 2020 ( partly covid related) which meant it took about 6 months for us but that is much longer than usual. You need someone with very recent experience.

Mine took 3 months last year, it was an uncomplicated probate as well. Hopefully would be quicker now!

Last year my DM's took 6 months, the legal and land registry stuff for the actual house sale was delayed too. I would hope they have sorted themselves out by now, but it could still be longer than 8 weeks I would have thought.

We did run the sale through at the same time as waiting for probate, but at some point, you have to stop, because the house has to be in the executors name in order to finalise the sale.

I lost my father in October and was told approx 20 weeks, back then, by my solicitor. As it turned out the banks involved didn’t require probate for the savings and he didn’t own a property so I didn’t need to go ahead. However, my friend has very recently lost her father - just before Christmas and she has also been told probate may take up to 20 weeks at the moment. I imagine staff shortages are impacting things significantly.

We bought a probate sale last year, took 3mths, the family had applied for probate before the property was marketed.

I did probate twice in 2020 (it was not a good year) and the first one took 5 weeks, the second 2. But what did take time was all the preparation in getting the IHT and probate submissions in, and that took 3 months the first time and I was going as fast as I could. So be careful to separate the two things - -I wouldn't commit to anything till they've actually submitted

I was a bit taken aback it was on the market before they'd even filed! But it is my dream area and could be really nice (but would need a full survey, and not sure about spending out on that when probate is still up in the air!)

It took 9 months for probate in my dads estate, started in dec 2020. It was so stressful!
