Built over drain?

Hi,

We have bought a house with a drain built over in the conservatory (pre-dates the time when needed an agreement)
The conservatory is knackered and needs to be replaced and we are planning on doing a block built extension.
Will we need to get a build over agreement from water company or will it be OK with the fact it is already built over?
