Hi - I've just been sent the contract by my builder. It covers the following for dispute resolution...

Any ideas why they're saying I couldn't apply to the National Specialist Contractors Council for adjudication? Is this a red flag?

Would you agree to this contract term?

Have you asked them? As a lay person’s guess, it may be because they aren’t a specialist contractor and therefore adjudication under a scheme which represents those members wouldn’t appropriate. A quick look at the NSCC’s membership suggests that they are all contractors in quite specialist trades and services.

Though I’m sure somebody more knowledgable will have better advice. Alternatively, call the NSCC and ask if it’s a standard clause.

You have to pay a membership fee to get access to one of these schemes. They are obviously members of a different scheme.
