Need to disclose mice?

Help! We're due to exchange tomorrow and it's only just occurred to me we might need to disclose that we have mice. It's literally only something we've known about for about a week and we've already had someone in to sort it out. Do we need to tell the buyer?

Yes you absolutely need to tell them unfortunately. If and when they find out you could be liable as it's not something you could claim you didn't know about.

You cannot say nothing. Imagine if it was the other way around!

I can see it's something I would want to know, although hopefully they'll be all gone in 2 weeks.
But do I legally have to disclose it via the solicitors prior to exchange? Because both our solicitors are pretty impossible to get hold of at the moment and I don't know how that's going to work

You could email the solicitor? We were explicitly asked about rodents in the enquires.

Oh were you? I couldn't remember. Although when I filled all that in we didn't have them! I think I'll try and get hold of the buyer direct maybe

Ask your solicitor first. If you contacted an exterminator and the problem is resolved you might not have to say anything.

Don’t go direct to the buyer. Tell your solicitor. For a start, they’ll be able to advise if you need to pass this on, if it’s being solved. I think you do, but they’ll know for sure.

And secondly; you’ll be able to prove that you told them through the correct channels if you need to in the future.

They said we should disclose it although it didn't sound like we absolutely had to. Thankfully the buyer was fine about it
