rainwater drainage from neighbours drive onto my drive

hi,

My neighbour has installed a new blockpaving drive outside his house, which is on a pronounced slope. my double garage is below their lowest point and so the entire area( 50M2) will discharge in front of my garage.I have asked the neighbour to install a drainage channel to pick up most of the run off, but this has fallen on deaf ears. i don't believe he is allowed to do this. I have a drainage channel in front of my garage front to cope with my drive run off. I am afraid that heavy downpours will flood my garage.Is there any solicitors here who could give some advice?

Do you have legal cover on your home insurance? I'd use them.

Discharge of rainwater onto your property is a nuisance in law.
My parents’ neighbours put a down pipe on their garage gutter to drain onto their flowerbeds. The runoff killed several plants as it washed away the soil. My parents told them this and they moved it so it flowed over their garden instead.
If he is not accepting what you have told him I would check if you have legal cover in your home insurance and if so contact them and get a solicitors letter sent.

If it’s a new driveway then planning permission might be needed. To be considered permitted development the driveway needs to be either permeable, include drainage onto their land or be smaller than 5sqm. I would contact your Council to ask them to send someone to check it. The Council will not tell the neighbour who has complained, however, it’s probably easy to guess

If it's actual block paving with sand between the bricks won't most of the rain water absorb where it falls rather than run off?
