Previous planning approval

Hi. Does anyone know whether an approved planning application is still valid if you make a different one after but it gets refused?

We've got planning approved on an extension but withdrew an earlier application because the case officer didn't like it. But delving in to what's been approved on the road before and since I think that it should have been approved. And probably would have been on appeal.

If we went for the original plans again but didn't get them through could we still build what is approved? As long as within the 3 years from that application?

The new, approved plans are smaller and more expensive and I'm really struggling to get over it! Plus I don't know where we'll find the extra money. I'd rather at least give the original plans a try and if they get rejected at appeal then at least I'll know I gave it my best go.

Yes as long as the PP hasn't expired you can still implement a permission even if other proposals get subsequent approval.

The exception being if the Council don't want both permissions implemented, they may require a legal agreement to that effect. eg if there were permissions for a side extension as well as a rear extension.

The two plans are basically the same extension. But the first (rejected) one was a bit bigger and simpler.
