Neighbours dog getting into our garden

Just wondering who is more responsible.

Neighbour put up a shoddy fence a few years ago. Fence has deteriorated. Neighbours dogs originally damaged the fence to get into our garden and damaged it further trying to get back out. Another of their dogs now keeps getting through and coming into our garden.

We're in the process of getting our own fence, inside our boundary that will sit just in front of theirs. In the mean time, who is responsible for keeping the dog out of the garden, them or us?

Check your local council website. Will probably explain it on there. Or google Dangerous Dogs Act.

Can you just talk to them? Ask them to repair or replace their fence as their dog keeps coming in your garden?

They own the dog. They are responsible for making sure the dog doesn't leave their property on its own.

They own the fence. And should repair it if it is damaged, especially since they should be making sure Ddog can't get out.

They are. As a dog owner they need to ensure their dog is safe and not damaging your property.

We have a dog and ensure all the fences between us and the neighbours are safe/dog proof. We have 9 properties adjoining our garden and don't have responsibility for any of the fences but don't expect our neighbours to have to ensure their fence is sufficient to keep out our dog

We do think they're responsible too but we had an issue with them a couple of years ago after the first time it happened when they said we needed to replace the fence.

We had a video of their dog in our garden and chewing and pulling at the fence, causing more damage, to get back into theirs, but they haven't done anything to sort it.

I'm happy to put our own fence up, inside our boundary, but don't want them to then take theirs down and essentially give them more space.

I don't think they'd contribute to a new shared fence, they're very hostile.

Don't put your new fence up before speaking to them first. Like you say, they could take theirs down and your new fence is then more likely to get damaged by the dog (and whatever else!)

They're responsible for keeping their ddog on their property.

The issue of who is responsible in the deeds for fence repair can be a separate matter.

They are responsible but like many dog owners, they are selfish fuckers.

Tell them you have a rat problem and are putting bait in your garden, so they would be wise to keep the dog under control. You don't actually have to put bait down.

@murbblurb i wouldn't be suprised if they had rats, their garden isn't in the best condition.

We will approach them about contributing but they are very stand offish. They used to chat over the fence until the first incident, our DC goes to the same nursery as their GC and they ignore us at pick up and drop offs Hmm
