Any Enforcement officers out there??

Our neighbours have built a large gazebo with a pizza over and bbq right next to our boundary. It is about 4m by 6m and the roof is 3m high with flues measuring an additional 1.5m. We live in a rural area on a terrace street with our garden sloping down towards theirs. Our garden and the views from our house are now completely overshadowed by this outbuilding and when they have had friends round we cannot enjoy our garden with all the noise, cooking fumes and smoke venting into our garden. We have raised this with our planning department and they believe our neighbours are in planning breach, asked for photos (cannot visit yet due to lockdown) and said they are going to write to them next week to suggest changes and if none are made they will have to apply for planning permission retrospectively. What do you think our chances are of having the cooking equipment and flues moved to another part of their garden? Now the weather is getting better we feel very depressed we cannot enjoy our garden.... Thanks in advance for any feedback x

I would say now the council have been notified they will not take kindly to it. Even if it’s too high ( they can reduce it ) I don’t think you can do anything about the cooking outdoors and them enjoying the garden.

No luck whatsoever about getting their bbq and pizza oven moved. Be careful what you wish for, large lumps of fat on a bbq or kippers are not something you really want to experience...

If they are within 5m of the boundary 2.5 metres is the maximum height of the structure so you may be able to get that changed but I’m not sure they can enforce the BBQ is removed.
