Leave dh) can I move into my buy to let for a few months until I can get my finances sorted to
By my residential property? My flat is empty.. so I don’t want to pay rent and pay for mortgage on an empty flat.. please advice

I'm curious why you think you might not be allowed or able to do this?

If you own it, and have the key, just do it.

What sort of thing are you worrying about? I don't know about what happens if you change your main residence, and assume you will continue to pay the mortgage on both properties. It might have capital gains tax implications if you sell a buy to let, but I don't really know.

My friend has had to do this in a similar situation.

You might get into trouble if the building society found out, as a BTL mortgage is not for people who live in the house themselves and you would be breaking the terms of the mortgage.

Is STBXH likely to inform them? The worst that can happen is that they want you to convert it to a residential mortgage, but they might let you stay temporarily if you knew it was for a set period of time.

Ideally you would speak to your mortgage lender and buildings insurer as there will be clauses against you living there, but it's hardly an outlandish scenario so it might be really straightforward.
As above, CTG rules are different for divorce settlements but it's probably to your advantage that it's your min residence.

I am worried that lender will find out.. as I want to change my address etc to BTL.. while I
Sell my main residence in the coming months and buy something bigger For myself and children..not sure if I will be able to get a residential mortgage while living in Buy to let.. seems too much hassle to do all these changes to live somewhere for a few months and save on extortionate rent( I appreciate I do the same to my my tenants).

Could you get a postal box instead of changing your address to the btl? Then it's not linked to where you're living.

You do need to fess up really, if you needed to claim on the insurance you'd be really stuffed. Could you speak to your mortgage broker to test the water? If you don't have one, I've recently used Coleman Mortgage Consultancy, she's good.
