Has anyone done a section 75 claim against a builder?

We are starting a claim today, having paid for a survey that is pretty damning of the work done.

We have been 'negotiating ' with the builder. We offered him mediation 2 months ago, which he refused. The day before the survey he said he wanted to mediate! The surveyor said he would do mediation instead, but then the builder changed his mind. The survey will form our Expert Witness report.

The builder now wants to see the report. I don't know whether to send it to him. He will, I know, refute everything in it and accuse the surveyor of lying. This is how he has operated so far, he would swear black is white.

The quotes we have had to repair the work are for more than we paid in the first place as everything needs ripping out and redoing- so bathroom comes out, flooring throughout goes (including the underfloor heating), all pipe work and electrics removed and replaced.

It is a total nightmare

make sure you file a claim in the builders name and his company name. That way if he winds-up the company you can seek to bankrupt him personally - at the end of the day that is the one thing he won't want @Movinghouseatlast

@curlysueyouknowwho you can't do that if someone is operating as a limited company.

If they wind the company up that's it- no money.

I strongly suspect he will wind up the company, hence the section 75 claim!
