Can a vendor pretend they are willing to sell through an estate agent but they are only testing the market in order to decide on a private sale?

Depending on their contact with the agent, they might get heartily sued by the agent.

I presume they don’t have any contract with an agent? Is it a negotiation tactic?

They do have a contract as far as I know but I heard through good sources that the vendor was approached directly but the EA does not know.
