Shed guttering

Hi, my neighbours guttering overhangs my garden and I've asked politely by letter that they reposition it as I want to put a fence there but they won't. Can I remove it?
The reason I'm having to pop a new fence up along side their fence is because they won't let me paint my side of their fence! Neighbour dispute and bullying that's now been going on for 14years!!! I'm tired out 😞

Not an expert on property law, but when a neighbours tree stats over handing your property you are entitled to remove it as long as you offer the cuttings back.

Assuming they haven't claimed your land on the basis of adverse possession I would have thought you would be entitled to do the same but be mindful if this starts a neighbour dispute the consequences can be far worse and you may need to declare it if you wanted to sell (as must they)

Also, if the water runoff falls straight onto your nice new fence it won;t last that long!

So many threads lately where people won’t let their neighbours paint their side of the fence!

What am I missing? Why is it such a big deal to let someone paint the back of your fence when it protects the wood and you can’t even see it?!

Do you even have to ask to paint your side of a fence?

@PaulaSmith1

Do you even have to ask to paint your side of a fence?

Yes as it isn't yours to paint. If it is jointly owned then different but very few are.

We had to pay for all the fencing around our garden as the neighbours refused to cough up. What I now have at least is all the fencing is the same colour. They have asked to paint theirs and I have refused as due to the type of fencing it is nearly impossible to paint just one side without leakage through...and I take the view I paid for it and they refused.
