We’ve had all our searches back now. Turns out the road is a private road (it’s like a little offshoot from a bigger road, with just 4 houses on it) with no clear owner. Our actual house is actually entered via the main hill road as we are on the end, but our front boundary is on the private road. Vendor has taken out an indemnity for it but don’t know if I should be concerned?

Other than that enquiries are nearly done, I’m desperate to exchange now I just want it all over!

Hello!!!!

Gosh I fell down a rabbit hole post moving and Christmas and then last minute we went abroad for a trip to see family. It has been FULL ON.

@MrBobLobLaw massive massive congratulations!!!! Stunning baby and name (I’m so sorry I’m so late)

We completed as planned on the 8th. We met our buyer - accidentally - I resisted the urge to wallop her. Bloody LOVE our new house. Have been having LOTS of fun doing decorating and furniture purchasing. First time we’ve bought new proper furniture in over ten years!

Good luck to all still going through and congratulations on those who’ve crossed the finish line!

Congratulations @MeganChips and @Mama12345678 for getting an offer - do you think you can negotiate with them to get it higher? Also congrats @squiglet111 what a relief! Is that the only issue that’s come back so far?

@AGreatUsername do you know if the current buyers contribute to the maintenance of the private road? I assume if there is a pothole or damage to it it’s not the councils responsibility to fix, so would worry about potentially having to fork out. That said, what are the chances of damage on a road with only 4 houses.

@Simonsays the road is very run down and in bad condition so I presume no one chooses to contribute anything. But in the event of a legal procedure I guess all 4 houses would be legally liable to pay a share. I don’t mind so much, but when they surveyor was there a neighbour came out and shouted at him for parking on a private road. I don’t want my visitors, parked right outside my house, shouted at! Surely if no one owns it or takes responsibility you can’t shoo people off it?!

@AGreatUsername we have a private road currently. Ownership of strips is based on where our house is but the deeds clarify that all properties have to contribute to area where it is shared access. We had an issue with two elderly neighbours saying that they would only pay to the bit that used.

Our solicitor wrote and said this would lead us to all having to pay for own bit only and these two owned the most used bits and would be solely responsible for upkeep but legally obliged to ensure access was possible. They changed their tune then when they realised it's their bit that would need repair first!!!

For just 4 houses it will be easier and liability for repairs (shared or own land etc) will be in the deeds.

I'd be worried about the neighbour though. I'd have to meet her and see if she can be nice!!

It’s not mentioned in the deeds at all. It’s a bit odd. I’m very worried by the neighbour. In reality I won’t use the road much as our access gate is on the main road, but there’s an entire car parking space outside our house there which I do think we’d be entitled to use if it was empty!

@AGreatUsername I'd be inclined to raise a question via my solicitor about the use of the carpark if space by the current owner and if there are any issues from any neighbour ...

@Simonsaysitschristmas I’m pretty confident we can push the offer up - at least I hope so because we rejected it this morning! We have another couple coming to second view this afternoon, waiting for a response from a third couple who were v positive at their viewing and have another new viewing tomorrow so I’m not too worried about selling it now. I’m much more concerned there’s nothing out there we want to buy! If we accept any offer it’ll have to be on the condition that we have time to find somewhere.

She’s already gone back with that, the seller has signed a sworn document saying she’s used the road for twenty years so when we complete the solicitor is going to try and get a Right of Way established with the Land Registry. I’m waiting to hear if there any issues with the neighbour, another worry!

Finally heard back from the Estate agents. According to the sellers solicitors it's a defective lease, whatever it means. The solicitors were our vendors solicitors three years ago, so happy enough to sell the property...

Our buyer hasn't even paid for searches yet either and he's on holiday! He put pressure on us because he supposedly wanted to exchange very quickly.

Can I join? Starting to panic, we’ve accepted an offer on our house but had 3 offers turned down 😫 waiting to hear back from our latest offer. Just hope our buyers are ok to hold out for us!

Yes got 4 more houses booked in but further away from ideal location as it’s so sought after. The one we’re waiting to hear back from has said they’ll let us know Monday

We have finally decided to remortgage our existing house and then buy our next without selling. We have been on the market since May last year after foolishly listening to an over enthusiastic estate agent, and marketing with a price that was way too high. Despite dropping dramatically and changing agents, we have only had two offers and they have both lost their chains.
So we found a chain free house and have had offer accepted today. I feel so relieved to be finally underway.

So we heard back from our estate agent that the buyer has no issues with the survey, so that’s good. Their solicitor went back to ours with a few questions and I’ve answered those.

Our new house is being valued on Monday and housescan are doing the snagging.

I’m still checking out right move tho and really want to view two properties, am I going mad? Anyone else doing this...

We've exchanged!!! We had our offer accepted in August (!) and we've been waiting ever since then! 2 weeks to completion :)
