Is this a reasonable request?

I want to put an offer in on a house that I have fallen in love with. I have the deposit in place and a mortgage Agreement in Principle for more than the house is on sale for.

However, my name is still on the mortgage for my house with my ex and the mortgage broker has said I won't pass a full credit check with my name still on this mortgage. I am waiting for him to buy me out but he is dragging his heels a bit. I have sent him a solicitors letter this week threatening court action if he doesn't send an agreeable timescale for buying me out.

My question is, can I make an offer to the vendor with the condition that they have to wait until my name is off the other mortgage or is that mega-cheeky/unrealistic?

*As context, I'm not in any other chain as I am in private rental at the moment and the vendor hasn't bought another property yet so they may not be ready to go for some time. The house has been on the market for 2 months.

You are not in a position to proceed. If it was you selling, realistically you would not take your house off the market for someone who is offering but cant give a definitive timescale because they are tied up in this way. I think you nedd to pause the sesrch until you get the situation with your ex firmed up.

You need to get your name off the mortgage before you can realistically look and be considered a serious buyer. You need to speed this up so you can get settled.

If I was selling, I'd be happy to keep your offer on the table but wouldn't stop showing others around.

Can u not get your name taken off the other mortgage or is that impossible just now?
U could do this under a solicitors and get an agreement that still entitles you to whatever it is u want bought out for ?

I would keep your offer on the table but I wouldn't take my house off the market.

UPDATE

Thanks for your replies everyone.

I put an offer in and explained my situation to the Estate Agent . The vendor accepted the offer on the condition that they wouldn't remove it from sale until I had proof my name was being removed from my previous mortgage.

Ex-partner finally applied for his new mortgage and sent me confirmation that he had applied which was enough for the vendors to be satisfied that I was serious so they took it off the market and I am now officially buying the house Grin. The estate agent said it's fine to run the processes side by side so whilst the morthahe to buy me out is going through, the sale stuff will be going through and also my mortgage application.

The mortgage broker says he can submit the application for my new mortgage with the condition that the money isn't released until my name is off the other mortgage but everything else can be done in the meantime.
