Has anyone ever served a section 8 notice?

I recently discovered that my tenants have been subletting, and by doing so have turned my house into an unlicensed HMO. I’m about to serve a section 8 notice to evict them, and was wondering if anyone has been through the process before and could give me any advice.

Get proper legal advice from a lawyer with experience in landlord and tenant matters. You'll need proof for this under s8 and if they don't go you'll need to convince a judge. You might want to serve a s21 notice at the same time. If they don't go you may have to get a possession order and use bailiffs. Also get advice on the HMO issue - now you are aware of it, do you need to do anything to protect yourself?

I’ve actually already found a solicitor who specialises in property disputes, and am waiting on an okay from the other owner. I can’t serve a section 21 because their lease hasn’t expired.

Thanks for flagging up the HMO issue - I’ll raise it with my solicitor.

You can serve a s21 in advance as I understand it - so if you have any issues with the s8, the s21 notice will kick in at the end of the period. Depends whether it's worth doing that and how long is left on the tenancy will have a bearing on that.
