Can I put a taller fence in front of neighbours fence?

Behind our garden there are bungalows, who share communal gardens. The fence at the back of my garden is part of their communal fence - the council are supposed to maintain it with it being communal, rather than the residents.

Our side fences are 6ft (with gravel board and panels), but the back panels are 4ft tall. It’s also rotting and breaking away. Rather than bother with the council, we want to just put our own up in front of it, to match the rest of our garden (our hypothetical fence is the dashed lines on the picture)

Will it be ok to put a taller one up?

There’s a huge tree right behind our garden, and the bungalows are quite set back away from the fence, so I don’t think it would affect them (e.g light) in anyway other than they would see the top of our fence. Apart from that, are there any other issues I should consider?

You can but you'll be giving up a bit of your garden.

Yes it’s fine, so long as it’s on your land and not higher than permitted.

That’s what we did a few years ago.
The garden of the house that backed onto ours was on a slope so when they stood at the fence they could peer over it and they never maintained it, plus their bushes were growing over into our garden.
We built a 6 foot fence inside the boundary (original fence was theirs)
