Tenant not moving out

We gave notice to our notice in mid October with moving out date in mid January. He's still there! Lots of excuses as to why he's not moving out but he's still there

What do I do? Should I just start court proceedings? Luckily our estate agent is on top of it but it's all a bit nerve wracking! At least he's still paying rent but it's really annoying!

If he's got a habit you could try offering him money to leave, other than that, it's going down the court route unfortunately :(

Yes you've got to get an eviction notice through the court now.

Is there much availability in the area? Is he waiting until he's evicted to get a council property?

Did you give notice correctly? Also, why do you want them to go, are you selling up?

At the end of the day, no matter how good previous relationships, no one wants to have to move so many tenants will push it out as far as they can and I understand that. Providing you have served notice correctly, you should apply to court for eviction and hope he gets a move on. It may be, as others have said, he's awaiting eviction so he has to get local authority help (although I thought law had changed around that so you didn't have to force your LL to evict?)

we technically don't need him out but He's a hoarder and the flat is an absolute tip. That's why we are kicking him out

And yes we served section 21 via the estate agent so paperwork is all good there

He's said he's found somewhere but waiting for paperwork but this has been dragging on for a few weeks and I'm losing patience now.

The section 21 just says if he doesn’t move out by x date you’ll start court proceedings. So that’s the next step.

Thank you, I think we are going to have to start court proceedings as it's taken way too long now. I shudder to think of all the ways he's wrecking our flat

Honestly it's stuff everywhere Sad

Ok. Just be aware it could take another 6 months to actually get them out, and that they may leave the mess behind.

Obtain a County Court Judgement then transfer it to the High Court for enforcement. It will cost more but eviction is quicker.
