Bought a bottom flat which is leasehold and it had been empty two years. The upstairs flat (only two flats) are trying to use 3 ft of the concrete yard. They have while it was empty installed an outside tap and a washing line and keep their bins there. I moved in at the beginning of the year and asked them not to use my yard. I want to put a fence up at the edge of my land but they refuse and say it needs to be 3ft in so they can use the tap and the washing line. The plan that is registered with the land registry shows the yard is my flats. There is also shared land around the flat and they are using it for their car and there’s no room for my car and if I leave my bin on the shared land they move them to the yard. I put my car on the shared drive when they were out once and they screamed at me banging the door until I moved it. My lease shows it to be shared land clearly and the yard mine alone. They want to use the first 3 ft of my yard. Can I put a fence up to stop this along the boundary or do I have to let them use my yard? Freeholder not interested and won’t get involved. I just don’t want them in my yard and I want to be secure. Am I wrong?

Take photos and keep them in case you "accidentally" damage their car. serve them right

I’m collecting evidence to show the court. The more they act unreasonable the better for the court case.

If the drive is shared you have every right to remove the gates... personally that's what I would do, can't lock fresh air can they!! But that's because I'm a devious cow lol xx

Is it fully on the pavement? All four wheels? If so you could park next it, in the road, blocking its passenger door. I’m assuming that they got in and out of the passenger door as the drivers door is to close to your gate to get in and out.

Can you post a photo of how the gates are fixed in place?
Unless they are welded ,, there must be some way of removing them

I’m going to wait until they go out and go look at the gates again.
Both of us own as leaseholders. The council is the freeholder.

Yes all four tyres on the pavement. But I would be as bad as them and they would kick off again and I don’t want confrontation again after the previous violence.

Bloody hell !! Get onto the council and make a complaint, also I'm sure they can't block you in like that too?! Can you ring the bin emergency police?

I would have thought you could report that car as being illegally parked given it is preventing you from leaving your property. Especially as the police already have them on record as harassing you.

My other neighbour said they hounded out the previous 6 tenants of the flat at least with their behaviour. One lady had a baby and every time it cried they stormed down stairs and shouted at her. Nice!

They just went out. The gates are held on by rusty screws with a bolt. I tried to move the screws but they are rusted shut. Tonight I’m going to wd40 them!

Phone the police and get them to send out a PSCO to issue a ticket for obstructing the pavements, every time.

If you were wheelchair bound or had a pram how on earth would you manage?

Also, post the pics on parking idiots type Facebook pages, there's some particularly for disability abusers who would maybe help advise.

Couldn’t get the bin from the back garden last week either so now having to keep them in the front garden as I missed the collection.
I think I’m going to call the police each time.
