Boundary dispute

Bought a bottom flat which is leasehold and it had been empty two years. The upstairs flat (only two flats) are trying to use 3 ft of the concrete yard. They have while it was empty installed an outside tap and a washing line and keep their bins there. I moved in at the beginning of the year and asked them not to use my yard. I want to put a fence up at the edge of my land but they refuse and say it needs to be 3ft in so they can use the tap and the washing line. The plan that is registered with the land registry shows the yard is my flats. There is also shared land around the flat and they are using it for their car and there’s no room for my car and if I leave my bin on the shared land they move them to the yard. I put my car on the shared drive when they were out once and they screamed at me banging the door until I moved it. My lease shows it to be shared land clearly and the yard mine alone. They want to use the first 3 ft of my yard. Can I put a fence up to stop this along the boundary or do I have to let them use my yard? Freeholder not interested and won’t get involved. I just don’t want them in my yard and I want to be secure. Am I wrong?

Well, they're going to have to choose whether to continue venting their feelings or losing face by being prosecuted (criminally or civilly)! Ridiculous of them to paint themselves into this corner. I'm glad, though, that you're keeping records of all of this. If they aren't the type of cowards bullies toback down at the last minute, it could continue to be unpleasant. 😞 However, you sound firm and sensible. Good luck!!

They were shouting I was a f*ing stubborn bitch, and I agree with them! I am!

Wow they really are unhinged. I'm glad the police are taking it seriously.

Bluebird29 · 01/05/2018 09:11

It’s going to hit the fan today. The fencing contractor is coming. They won’t be pleased.

Good luck Bluebird, I'll check back later to see how your day went.

Remember if they kick off, it'll be in front of witnesses, the fencing contractors, and call the police. If they've already been warned once they'll be risking trouble.

snewname · 01/05/2018 09:48

Do they realise it's all on cctv?

snewname · 01/05/2018 09:49

Have your phone on to record them if they confront you away from the cctv.

AgathaF · 01/05/2018 09:58

Some very odd people around. I hope it goes well today, although it sounds like it's unlikely too.

InfiniteSheldon · 01/05/2018 10:25

Hope it goes well

MrsBlondie · 01/05/2018 10:37

Hope it goes ok Bluebird

Bluebird29 · 01/05/2018 10:45

I’m at work but yes the cctv is working so they should know it’s all being recorded. So far I’ve not had any calls saying there’s trouble but I left the land registry plan with the contractor.

Though the fencing contractor said he popped back while I was out a few days ago just to check measurements and they tried to tell him not to do the job but he ignored them.

FiloPasty · 01/05/2018 10:50

God this has escalated, good on you for standing firm.

mummmy2017 · 01/05/2018 10:54

Some people really are stupid.. they think being a bully will beat you...

Bluebird29 · 01/05/2018 11:30

It was stand firm or let them win and let them have my land. Not an option, anyway I’m a stubborn bitch!

Good luck!

Thegirlisnotright · 01/05/2018 14:40

Do you have the title deeds for the property from when you bought it? Do they definitely agree with the land registry boundary? Just to be sure you’re arguing the correct boundary.

Notmorewashing · 01/05/2018 14:58

Good luck stay firm

Bluebird29 · 01/05/2018 15:17

Is your fencing up? Am hoping no news is good news!

maymai · 01/05/2018 20:10

What an awful situation. Can you find out if there were problems with them when flat was last occupied? If so you should have been notified!

Strawberry2017 · 01/05/2018 20:24

They have basically taken advantage whilst the flat you now own was empty for so long and seem to think that gives them rights.
Good luck - they sound awful.
