Yoga - ea didn't know why they haven't gone through them. Our vendors are moving into an empty house so very short chain. I was very laid back about it all before today but now I'm worrying!

Can I join? Was supposed to exchange over 2 weeks ago on a chain free property. Still haven't exchanged due to seller's incompetent solicitor. Seller is going to move in with partner and then they're buying a new build. Solicitor C can't grasp the concept the sales are separate, solicitors A and B who agreed we're ready for exchange today are both not in the office today. I'm fed up and about to pull out.

Everything continues to get worse here. Been having a load of nasty, bullying harassment from cubitt & west. I honestly can't warn people off of them enough. Not only do they refuse to remove our house from the internet, they told us we have to give them 14 days notice, despite us having done so in July. Us attempting to proceed with one of their buyers apparently "resurrected the contact" so we need to give notice again. Hmm

Worst thing is that despite us repeatedly telling them we want nothing to do with them they have now changed their advert on our property to available, are fully marketing it & trying to bully us into accepting their viewers. Apparently if we refuse we're "obstructing them" in the terms of the contract. I am sick to the back teeth of these complete arseholes & will be counting the days until we are out of contract with them AGAIN & can instruct a new agent & hopefully find a new buyer before our seller does! F*k this s*t! Angry

Pixie in your shoes I would seriously go and pay for half an hour with a lawyer, take them through the points you've just raised and get some sound legal advice. I don't understand how contracts can be 'resurrected' unless there is a clause in there covering this type of scenario? Either way, legal advice might place you in a position to write them a strong letter and tell them to do one.

Oh and you are under no obligation to allow viewings regardless of what the contract says. You have a legal right to 'quiet enjoyment' of the property. I'd be very careful that they aren't just letting themselves in when you aren't there though.

I would like to join too, suppose to exchange and complete end of this month, that was 3 weeks ago. The freeholder went for holiday, he's now back (or that's what I'm been told), and we cannot do anything else now until his majesty completes his documents correctly, Angry quite nervous because the freeholder is only contactable by letter, no emails, no cellphone. Shock The building is maintained by the tenants, so no professional managing agent that can help out. Stupidly for us, we already gave notice for our lease, buy furnitures and even adopted a puppy. Blush

Stress levels rising here too. We are pretty much ready to exchange but our tight vendor has instructed useless solicitors who just don't respond. We are all working to a deadline for exchange so we can complete Pre Christmas but the middle solicitor is taking days to send anything on. Our vendors are now overseas and are not pushing their solicitor so nothing is moving.

We need to get exchanged so we can apply for school places. Only one school on the local area has spaces in the right years. The other school only has one space and they said we are welcome to apply for that space and then speak for the other child to get in but I just done understand what that means. On what grounds would we appeal??? Then we are trying to figure out secondary schools as they all feed into different ones and I'm trying to work out the difference including transit issues and my mind is exploding.

I feel ill with stress. Just want to curl up under a rock and sleep until it's all over Sad

Raa we're also dealing with a party whose solicitor refuses to respond to any chasers. We're now entering our fifth week since we tried to exchange contracts - and since we were led to believe that everyone was ready. Our stuff is in storage and we're packed and living out of suitcases!

Pixie, you need to talk to your solicitor asap. Most EA contracts state they can charge you their full fee if you proceed with a buyer they initially introduced you too within a six month period of you giving notice. That's what stopped us moving EA. You really don't want to get stung for their fees as well as someone else's.

I hope you and everyone else makes some good progress this week. We're on day four in our new house and I can absolutely promise you the stress is worth it in the end. I'm sleeping like a log and I feel more relaxed and happy than I've been in months. Hang in there! Flowers

Oh dear, some very stressful situations here this week. I don't have any advice but here Brew Gin Wine pick your poisons everyone.

Serial, I've looked on the EE website and can't find a mobile broadband thing on a rolling contract, only 24 month ones. I think I'll pop into their shop at lunchtime and see if I can find out more. I don't want to spend too much money in case we're lucky and our BB gets sorted quickly.

Still waiting to hear if our vendors are happy with the survey on their onward purchase... their EA 'can't get hold of them' which we know is code for 'stalling for some reason' I do not trust these timewasting assholes at all (our vendors that is)

Looking for no chain houses as I type! Sighhh....

Morning all
Someone drag me out of the depths. I've now offered on two properties but both times, the seller has gone with a FTB. Yday I offered more, but still she went with the FTB. I'm selling to a FTB myself and am nearly a month down the line. No one wants me to have their house Sad

So fucked off. So frustrated. My FTB will be in mine, and I'll have to move home, aaarrrghhhh!

Our contract is as Olivia describes Pixie - i.e. if you've terminated the contract but then sell to a purchaser they originally introduced to you then they are due the sale fee. Have you read the small print of your contract as it may be buried in there? If it doesn't say anything like that then I'd echo everyone else and advise you to speak to a solicitor.

Sell Flowers your perfect vendor is out there somewhere. As part of our [mythical] MN EA service we should offer a vendor/purchaser introduction service to pair up all of those looking with their perfect homes Grin

We have a second viewing tomorrow where they would like to meet us as they have some questions. I would say it sounds promising but we've been second choice so many times now that I can't get up any hope at all Sad. Our [lovely] vendors (LV) EA went back to LV with our new offer (based on Mr & Ms FTB's low offer) but we were told LV wasn't inclined to accept. Can't blame him really. That was yesterday afternoon and heard nothing since!

Thanks Yoga - sorry for the rant. Great that you've now had an offer Smile I am cried out so feeling ok today. Just so frustrated. EA actual words to me yesterday were 'you're in a great position but vendor warmed to the FTB's as they have no chain' Confused You'd think once you sold, and were this far down, a higher offer might have counted? But no. Onwards and upwards hey?

Buyers solicitor sent enquiries. Our solicitor replied to enquiries. Now they are waiting for buyer to send back one form. I don't know what happens next but I'm assuming it won't go smoothly. Sorry to those of you who are struggling with people who have forgotten how to do their jobs. At least it's only Tuesday, a lot can happen between now and the weekend

I understand Sell. I guess a FTB jut looks more attractive as the chain is shorter and should (in theory) be easier. But we wise women here know that that isn't always the case. Keep looking - your house is out there Flowers

We've heard from LV and he will take our offer (I SO love them) providing everything happens quickly. This suits us as we're on SVR mortgage at the moment and throwing good money down the drain on a 4.49% interest rate! So we're off to the mortgage adviser tomorrow evening to sort that out.

We're still going ahead with the second viewing tomorrow. If they don't then offer we'll go with Mr & Mrs FTB and tell them we want to complete by Christmas and to pull their fingers out Shock Grin

Bloody knew they were stalling...

Survey on their onward purchase shows subsidence so they are not continuing with it. HOWEVER... they finally seem to have screwed their heads on the right way and like us, they will be going into rented to save their sale. So now we are theoretically no chain

We have told them we found a rental in less than a week that takes pets and we know there's plenty around their area too so no excuses or delaying. Let's do this and get exchange #2 nailed...

(I have a feeling they are still going to try and delay and stall and be a pain but we'll see)

Got my survey report today - it’s 90% red warnings. But Nationwide are finally satisfied with the paperwork so should get my offer soon. Then I’ll feel like some progress has been made.

rara I feel your pain.

After seller's solicitor confirmed seller has broken the chain to allow my purchase to go through and that everything was in place to exchange on Monday, neither were in on Monday. Cover person has now put fear of God into seller that bad things will happen if they sale and purchase don't occur same day, essentially turning my chain free purchase into a chain, but confirming everything would be done so we could exchange today. Phonecall today - they can't check paperwork until Thursday (seriously, wtf?) which is too late for me to give notice on rental. My solicitor has emailed them to say if they don't exchange by tomorrow I want them to cover the extra costs. They haven't even replied.

Estate agent tried to brush it all off saying "they're covering their backs and making sure seller has a house". I firmly told her I offered on the basis of a chain free sale would NOT be covering the extra costs of the goalposts being moved and will be pulling out if they don't sort it.

Sorry to hear about your rejected offers Sell - I hope it's the universe telling you that the right house is just around the corner, but it could just be a jittery market I guess. There isn't much you can do I guess except offer what you are prepared to. Might be worth telling the EA your offer stands, in case the mortgage offer for the FTB falls through with a change in interest rates or for any other reason?

AnnPerkins mine is definitely 30 day rolling contract but I got it through Currys - can't see why EE wouldn't sell it directly though as it is their product not just data plan.

Hi all, we are three weeks into the legal process having had offers all accepted. Thankfully we’re in a small chain.
I’ve been lurking and getting loads of helpful tips from you all. It’s so good seeing those of you finally completing.

However our buyers who are renting have just told us that they will not hand their notice in on their rental until exchange (which I understand
) but that means they want a two (yes two) month period between exchange and completion. Is this normal? All advice gratefully received and we don’t know what to go back with. DH seriously peed off as we wanted to be in before Xmas. I’m trying to call the waters.

Fivemore that is a long time but common with renter ftbs - you could try seeing if they can negotiate a shorter notice period and/or paying their rental costs if it is because they don't want to/can't/no spare money etc to pay for dead time

Thanks for your input ladies. To clarify, we are not proceeding with a sale as introduced by ex agents, we were, & fully acknowledged a fee was due upon completion, despite the fact that the sale wasn't agreed until over a month after our contract had ended. Sadly this sale has broken down, & because of their misconduct we now refuse to deal with them any longer.

While I disagree that an additional 14 day period is needed, we grudgingly accept it & will not go live with a new agent until after that period expires. I reiterated in an email to them that we wish for all online presence to be removed & marketing to be stopped instantly, because advertising a property when the owners are refusing to engage is fruitless. Thankfully they did as I asked. They also responded to my email telling me they had spoken to the buyer, who confirmed he was still in touch with me & hoped to find another buyer himself. They are convinced we will try to pick up where we left off should these people become proceedable again.

This is not the case, as we have no intention of selling to anyone introduced by them, so they should feel free to keep in touch with the previous buyer to ensure all is as it should be as often as they wish.

I have also heard from the ex buyers agent today. He told me that the people we are hoping to buy from, (divorcing couple) have now added a whole new link, or even chain, (god knows how long Hmm) because of him deciding to add a house purchase of his own onto our already fd up chain. They are not re-marketing their property as yet because they're scared they'll end up with even less, but everyone else above them has apparently & their estate agent is s**g himself & hasn't dare to contact us yet. I told the buyers agent what the situation is several times during the conversation, yet he still felt the need to send a group update to everyone involved in the chain that he now has no part in ffs! Hmm I could of shouted "this is nothing to do with you anymore, your clients are not buying our house" at the top of my voice & he still wouldn't get it!

Its all a case of stroppy immature estate agents throwing their toys out of the pram because they stand to lose their commission. We really do win the prize of the most screwed up broken, stupidly long lying bullshitting chain of fantasist buyers & estate agents around at the moment. We're wondering now whether given that our sellers are unbelievable liars who can't be trusted, whether any of this could go through even if we do manage to find a new buyer! All I can add is, Im gutted I can't drink at the moment! Confused
