Is this actually legally 'wrong' or just morally arseholeish?

I'm trying to buy a property. The surveyor has said it's not suitable for a mortgage (for no reason and the mortgage company are appealing).

I've just found out (through ninja means and a lot of bloody luck) that he's wanting to buy it !

Do I let the chief partner surveyor know at the company? My mortgage provider?

He's a young bloke and a right fucking wide boy.

I'm intrigued how you knew he was the surveyor just because he had paperwork from the surveyors in the car.

i bet sir humph will be at his most oleaginous! Congrats Op! and yes, I'd probably get another survey done, not least as the wideboy is obviously completely incompetent.

I feel a bit sorry for this bloke actually, he's possibility just put his career in the bin. Entirely his own fault though, you did the right thing to report this op.

User so if the chief surveyor has said junior was over cautious, it doesnt sound like he's going to take it further unless behind closed doors.

Are you still going to report to RICS

I don't care about the 'survey', it's not really a survey, it's just a valuation for the mortgage company. We would normally get a proper survey done but it's all been done up by professional builders and is perfect.

He had loads of surveyor branded paperwork in his open briefcase in the passenger seat. And his badge with his name on (which I didn't know). And a 'quality surveyors' with their branding as a sticker in the back window of the car.

The dickhead also has open Facebook settings and that's how I knew he was likely the surveyor that did my survey. I used his name to 'Humphrey' and he didn't disagree with me about him doing it. So clearly it WAS him even though I've not seen the report and no one told me his name at any point.

I've been very lucky that this hunch was right though.

He definitely noticed me cooing over the dog next to the car by the way. And raised his voice to the mortgage advisor to compensate Grin

Absolutely report it! For all you know, this might not be the first time he/they have done this, and who knows what else theyve been up to if they'd do this, you might be saving a lot of people from being screwed over in the future.

I can give thoughts in this, but at this stage I cannot decide without there having been a full investigation however in case as stated

Junior surveyor was in a position of trust as he was being paid by op to carry out a survey of the house.

Junior has abused his position as he is not supposed to do any act which Elwood make him a gain and at the same time cause op to lose out. He has phoned Mortgage company and said that property is not Mortgageable while at the same time trying to organise mortgage for himself for same property. A calculated act designed to make a loss to the op (opportunity to buy the property) and a gain for himself (opportunity to buy the property).

JS has acted outside his remit by saying the property was not ortgaheable, however as with all cases he would need to be given the opportunity to explain his actions.

Further to this he would then need to explain to his mortgage company why he was trying to get a mortgage on a property that was not mortgageable....or if he didn't do this he may have to explain (again in criminal interview) why he didn't tell his mortgage company about the fact that he had assessed the property as being unmortgageable. (Fraud by failing to disclose)

Op may wish to mention the possibility of Crimjnal Charges and a report to police to Humphrey too.

Humphrey's reply was like every single "old boy" fudge and cover up and demeaning mininalisation by a decrepit far-too-cosy and under-challenged man I've ever come across, be it in my own life or in politics/Westminster. They're villains in pin-striped suits.

When the dust has settled OP I would also consider reporting the surveying firm to your mortgage company. They would probably welcome the knowledge that one of their panel of firms is acting outside their professional accreditation (at best) or criminally (at worst).

Blimey! We had a 3 day delay waiting for a different surveyor as our property as the first was worried about conflict of interest as his son was looking to buy a property from the same developer we were.

So I'd say that silly surveyor man is being vvvvv unprofessional Shock

I've had the phone call and it wasn't 'Humphrey' who called me back it was the managing partner who was very untwatty.

He said the surveyor who visited the property wasn't yet fully qualified and they clearly needed to supervise and train him more closely. He was very apologetic and said I absolutely should report him to RICS.

He said he'd spoken to him and that there would be internal processes (I think he hinted he was firing him but he didn't actually say it). He said he was foolish and had let his 'desperation to buy a property cloud his judgement'.

He said he was sending me out a complaints form and that there would be a compensatory gift sent out to me.

The crucial thing was that he said he would supervise all dealings with the lender to make sure there were no further issues.

He also told me to make the estate agent aware. I'm assuming in case they fire him and he still tries to offer on it?

I think there were other things as the convo was nearly 15 minutes long.

I'm sure he was 'handling' me but maybe not in a bad way. I didn't distrust what he said.
