Is this actually legally 'wrong' or just morally arseholeish?

I'm trying to buy a property. The surveyor has said it's not suitable for a mortgage (for no reason and the mortgage company are appealing).

I've just found out (through ninja means and a lot of bloody luck) that he's wanting to buy it !

Do I let the chief partner surveyor know at the company? My mortgage provider?

He's a young bloke and a right fucking wide boy.

Well done! This type of behaviour makes me sick.

We had similar a long time ago. Appointed an EA. They came recommended and the price they wanted to market it at did seem low but they said they had potential buyers and we were in a hurry.

We found out after the event that the Estate Agent we dealt with, his sister bought it to rent it out. So he must have tipped her off, fixed the price low and bulldozed a sale through. We were at fault in not checking more carefully but it made me feel a bit sick after the event. We probably lost out on £20K.

If you do speak to him, also ask Humphrey for details of his firm's complaints handling procedure (RICS members must have one).

You can of course go direct to RICS as well.

RICS complaints

Make sure EVERYTHING is in writing.

And yes this is attempted fraud. He attempted to defraud the OP of the house she was buying. Absolutely a criminal offence. And very nearly got away with it. Wonder what else he's been up to.

on the upside, must be a pretty good deal if your surveyor liked it so much he resorted to unprofessional conduct to try and steal it from under your nose! I'm amazed at your catching him - ever considered a career as a detective?

user the police will not be interested until the OP has exhausted the other avenues open to her, so firm's own complaints procedure, RICS, etc. Doesn't mean she couldn't mention it to Humphrey though.

by the way just to calm any fears - I worked with surveyors (office above ours) and we used them...as firm I worked for was a solicitors, so referrals. Although maybe sometimes they were tempted to pull a fast one.... on the whole they took a very dim view of doing this and liked to 'play by the rules'.

Wooofudge, I am Afraid that you are incorrect, there has been a definite offence in the information provided by the OP, and all the elements of the offence have been met.

Whether or not the OP follows through on a complaints procedure is not relevant to the police investigation- the offence is purely down to the actions of the original sirveyour, not the company, not RICS the surveyor only.

The investigation of a criminal offence is not down to the public.

I say this with 13+ years of experience as a police officer.

Oh wow! Another one here in awe of your ninja sleuthing skills OP.

Just be careful about showing your hand to Humphrey from now on. He has shown his colours and I wouldn't be at all surprised to find that wide boy had already told Humphrey what he was doing. Entirely possible it is a common occurrence in that firm. So just be careful about tipping them off about anything.

My mortgage broker has just called me to tell me that the chief surveyor looked at the report for the lender and has agreed its mortgageable. GrinGrinGrin Its been passed on to the lender and will hopefully go through without a problem.

I asked her if she knew why (not saying anything to her yet) and she said that the chief surveyor indicated the junior surveyor was 'over cautious'.

I'm really looking forward to that phone call now.

OP, I don't mean to piss on your chips.

But you need a completely new, independent, survey. Paid for by Humphrey. No way can you trust anything that Wide Boy put in that survey. Not a chance.
