WDYD when you've completed and vendors are still in?

So we've finally completed on our property. We're waiting to get the keys but vendors are saying there is an issue with their removal service and can't move out today. Solicitor says they have to. They say they can't. Literally what do you do?

We almost had this with a reluctant vendor (divorce, wife making him sell), but he was a solicitor so was out on time in the end. Very stressful for everyone! As it doesn't sound like you're homeless in the short term it would, for me, depend one their reason for not being out. If it sounds like something unforseen and they are panicking I would be reasonable and give them a few days, under advice of your solicitor. If no good reason is forthcoming I wouldn't be so helpful and instruct your solicitor to do what's needed to ensure they move asap. Good luck!

I'm intrigued as to why people think this is the solicitor's fault. Do you expect them to do an inspection before sending any money? That's not how the buying process works. Vendors commit to giving vacant possession in the Contract. If they don't, then the recourse is an application to Court.

I completely understand why you did what you did op. It's not easy to 'get tough' with people when they're stood right in front of you. You know the law is on your side and I hope that will give you strength if needed today. Hopefully it won't be and your kindness will not backfire on you.

I don't think anyone's saying it's the solicitors fault, but that once the situation had happened, that the solicitor should be getting their finger out to fix it.

Agree that no one is saying it is the solicitors fault, but as they are the legal experts and are employed by the vendor it is their job to make sure that all legalities are dealt with correctly and advise when things go wrong.

Maybe not solicitor's fault. But a phone call reminding vendor of responsibilities and possible costs more might just be enough to frighten them to leave. Don't look a pushover as some people take advantage of 'weak', you have to look/be stronger than them.

So there's some back story from them...
They knew we were in with in laws and we were planning to rip the place apart and re do it prior to moving in and therefore weren't moving in on completion day. They are buying a new build and it's not ready...well it is but the paperwork isn't in place so their mortgage company won't release the mortgage funds. They are probably a week or so off this point and were holding out for it (although I suppose a week can turn into several)

They have had to not just arrange the usual man with a van but arrange for a removal company who does storage to come and move them today. They have young DC and were trying to avoid a hotel stay. They are having to do a holiday let instead now - not cheap given its the school holidays here.

They really were hoping a few extra days would buy them the time and it was cheaper to pay us than do what they have had to do.

I do feel a bit sorry for them. However, a bit of honesty earlier last week would have been better. They knew we had the builders booked and we'd been firm about the completion date to accommodate this so went ahead knowing they wouldn't be moving out last Thursday.

Anyway, it's all go and they should be gone by lunch. Solicitors have 't been in touch surprise surprise!

How incredibly selfish and underhand of them. Glad they're on their way out - I can see how you have sympathy, because you're clearly a decent person, but they have absolutely taken the piss.

I think their solicitors have been dishonest then , allowing it to complete but knowing they had nowhere to go nor arrangements for the interim. At very least you need interest on the money you paid over in good faith on Thursday and penalty for not ensuring vacant possession. Get your solicitor to write to theirs urgently.

Man with van removes to self storage unit you don't have to have a removal firm with storage facility.
Cannot understand how £3000 would be cheaper than just leaving and why going into hotel with small children is such an issue.

Let's hope they are gone by lunchtime. And good luck getting the £3k off them.
