WDYD when you've completed and vendors are still in?

So we've finally completed on our property. We're waiting to get the keys but vendors are saying there is an issue with their removal service and can't move out today. Solicitor says they have to. They say they can't. Literally what do you do?

Definitely do not enter into anything that could be construed as renting. Legal implications re safety, insurance etc for renting out. You are entitled to tell them to vacate property now, no ifs or buts and if they refuse then over to solicitor. Unless you have real proof of their insurmountable problem re van and are prepared to allow them to stay do not become involved. All terms and conditions should be agreed in writing and any expenses you incur should be included as payable by them.

So what should the OP's solicitor be doing if these people are not moving out first thing in the morning?

I would be hoping for something like an injunction and bailiffs, maybe?

OP has your solicitor contacted the vendors solicitor?

We had similar. We bought from someone who owned the house next door and was moving in there. They hadn't begun packing when we had arrived after the completion phone call and initially refused entry. We negotiated a room to put our stuff in.

Long story short we ended up helping them move out - right down to his dirty dressing gown hanging still on the back of the bathroom door.
That evening we saw them hoik their teenage son over the back fence to take snippets from the olive tree at the bottom of the garden. The brass neck of some people.

I can't believe you allowed them to stay after Friday.

Good luck for tomorrow. Be there on the doorstep at 8 am and tell them you are moving in. No ifs, no buts. You have PAID for that house. That means it's your house and you would like them to leave. Walk in and refuse to move. If they won't let you in call a locksmith and have the door opened from the outside. Then walk in and don't leave.

You have already been risking all sorts of legal problems as many here have said. Don't let it continue for another day.

Fingers crossed for you tomorrow OP.

Despite requests for a Friday, I've always insisted we complete early to mid-week in case problems such as this, arise. When we sold our last house a couple of years ago, we'd moved out on the Tuesday evening before completing the next morning. We were actually in another country by the time we completed.

OP best of luck for tm. We had exactly the same thing on our first house. Completed on a Friday morning. About 10 I get a call from estate agents that vendors removal van is having difficulty getting up the hill and they won't be out today. We too were staying with my parents and had plans to do work before we moved in. They did not know that. So I ring the solicitor who advises they need to be out today for legal/ insurance reasons already discussed. He agrees to call the estate agents for me, but it is the last I hear from him. Noon having heard nothing call EA who gives me vendors number and suggests I call them to arrange things. I hang up and swiftly decide I am not doing that. Ring back, get EA to ring vendors, they get back to me to say vendors say we can put SOME of our stuff in the house. After a lot of back and forth we finally pick up keys in EA just before closing. Go round to the house an hour later to find the vendor still standing there with garage load of stuff behind her. We walk up, awkward conversation ensues and we are 'allowed' to go in and take a look around. Oh and we got the garage keys posted through the door a day later. Never got a front door key.

Needless to say it ruined our experience of buying our first house. It didn't really feel like ours with the previous owner casually smoking a cigarette by the garage door.
