If a fixed fee no but if the quote was low compared to others you will get what you pay for hence the chasing. You can always ask them.

Wow i didn't realise that you could be charged for chasing up solicitors ( unless a fixed fee of course) I did a lot of that with our last solicitor ( he was bloody awful!).

Well i went into the estate agents this morning and asked for 10k to come off the asking price - bit of back story ... They put on the market for 269k which we thought was too much as we keep an eye on the local market so after a week and not so much as a phone call we got them to reduce it by 10k we have had the six viewings ( well seven if you don't count the second viewing) since we did that and then again today we asked them to take another 10k off so thats 20k in total and i did want to bring it down another 5k as well but our estate agents said we should not go down to our bottom line to give people some wiggle room..

I know that is brilliant value for a period property in this area ( i have seen others not on the road with the same floor space on for 340k so i really hope this will get us a buyer now. I was so tempted to tell her to put it on for offers in excess of 245 but she seemed to think that coming down the 20k we have should be enough and it will give people a chance to offer below as well as 245 is our absolute bottom line in order to buy the house we want.

Well it should show on right move tomorrow so i am hoping that we might actually get some viewings this weekend.

Hi dragon when I phoned a few solicitors before committing to one I got some quotes off them. They caried from £400-£800, so we went with the middle :) this is a fixed fee, then there were additional charges such as for searches and stamp duty. You shouldn't get charged for calling them x

If you're doing it on hourly rate they will send you a timeline break down with the bill. Scrutinise it and where you've chased them get them to write it off.

I am soooo frustrated! We were hoping to exchange today, I sent our contract off to sols on Fri and they've got ot which is great, they have a faxed copy of our mortgage offer, we have received a confirmation of our mortgage offer through the post, but the solicitor haven't received their postal copy yet, which means they can't exchange grrr!.... Hoping they receive it tomorrow and that it hasn't got lost in the post :(
We are kicked out of our rental tomorrow! Looks like we're moving in to a tourer caravan until exchange!

Hello again all! I'm still sat waiting.... waiting....
We accepted an offer on ours and had an offer accepted on our new house in Feb. Mortgage is all sorted, all searches are done, but we still wait. Apparently it's the ground rent extention that is holding things up, and waiting for the solor panel people to send a letter back. I'm hoping to move mid May so fingers crossed we get to exchange soon so I can pack. The hanging around doing nothing is a killer isn't it!

bear we accepted an offer on our house last August and finally moved in January. Our buyers never had a survey, just a valuation by the mortgage company. It could be that your buyers are the same??? We never saw them or heard from them after their second viewing, and DH never met them at all as he was away with work when they viewed.

Anyone else noticed how solicitors seem to "lose" documents in the post whilst buyers and sellers sit around twiddling thumbs and blaming each other?
They have the gall to charge a shitload of money, then can't even manage to post one document to another.
It's all " we'll we sent it last week and if they haven't got it yet its their fault" etc, etc.
How some if these people managed to get through law school is beyond me.

Magers that isn't our experience at all. We have used the same solicitors for three purchases/sales for more than 20 years now and they are absolutely fantastic. Very little has to go in the post nowadays anyway - most things are scanned and then posted so there is minimal scope for things to be lost.

I do think that people scrimp on solicitors fees and use firms from panels, don't meet the person who is dealing with their transaction, and expect a Rolls Royce job for peanuts. A very very good firm will probably have a very very experience legal ex/specialist conveyancer doing the work. Ours does. Can't speak highly enough for them.

Sadly we were told by our EA that we would have to use their chosen solicitor as part of their selling package.
Solicitor is miles away and our usual solicitor is just up the road so we wish we'd gone with him now.
We have our buyer and seller texting virtually daily asking what's taking so long and it's not even our fault.
Agree that documents should be emailed as its so much quicker.

I'm speechless magers. An Estate Agent simply can't do that. What on earth is a "selling package". Whenever I've engaged an Estate Agent we have invited three to value and meet with us. We've lived here a long time so we know who the good ones are. We have then given the deal to the one who we think will sell our property fastest and for the best price and who we think has been the most professional. We are paying 1.25% this time round (we could have got 1% with a different agent but didn't think they would do as good a job).

The estate agent works for you, you negotiate their terms with them and you call the shots. So indeed does the solicitor. Write a brief letter noting how often you have chased and ask for a written response noting what is outstanding and ask when those outstanding things are going to be dealt with. That needs to go to the Partner for Conveyancing/Property - ring them and find out who it is. Having said that how much are you paying?

One of our local EAs told me that, I pointed out I had a choice of 5 other locals who didn't expect me to use their soliciter and walked out. That really annoys me.

Oh the lies!!! It's amazing isn't it? Turns out the buyer who pulled out on us 6 weeks after offering had NOT had the searches done; in fact they hadn't paid a penny to their solicitor and told the solicitor that they had doubts from day 1. The solicitor knew this, but lied to our solicitor, right to the day they had pulled out. On the morning it happened he said the searches had come back, contracts were ready etc - all lies! Honestly, it makes me question everyones morals.....

So we have accepted the lower offer with caveat - that if the survey throws up anything; and I mean anything....then our price does not get lowered. We are literally knuckle to knuckle on how low we can go and how high they can go. If the survey throws up anything awful, then the other offerer has agreed to leave their offer on the table for 2 weeks, because we have room to talk that offer down, just in case it's so bleak that the lower offerer wants to pull out. I doubt all this; it's just speculation, but I'm covering our backs big style.

In any case, we're back on the path I hope, all be it delayed by a couple of weeks. In all of this despite all my preconceived ideas I have to absolutely thank our agents who have been bloody marvellous through all this (calling to check I was okay several times last week because I was so upset and she knew DH was away, sorting all our offers out on Sunday, answering the phone in the evening etc) and this is on a fixed upfront fee; they've had their money, so theoretically they could sit back and do nothing. And to be fair our solicitors have been good too - she had the draft contracts with the new buyer by midday yesterday - even our agent said that was the fastest she had ever seen! So although things are a bit squeaky financially now (DH won't be able to have his man cave shed complete with tatty chair and standard lamp for a while) but we will have moved, and thats the main thing. The chain on the higher offer was just too risky.

Off now to read through everyone elses posts.....

Hi, Long time lurker on this thread and my first time posting!

Put a deposit down on a new build last June with intentions to raise a mortgage and a buy to let against our current house as the rental market is good round here. After failing the buy to let mortgage we decided to put our house on the market in December.

New house is ticking along nicely tiles are on the roof and windows will be in this week. We used Barratts recommended solicitor and they were fantastic, the contracts were exchanged within 4 weeks and our move date is now just over 8 weeks away.

Since our house has been on the market we have reduced the price and changed agents and nothing yet. Fed up of time wasters. Did have quite a promising viewing yesterday but I'm not holding my breath.

The move into our new house is scaring me as we will have to do it ourselfs as all our spare cash is tied up in this house so we will hire a van and do the move bit by bit.

I had a massive breakdown yesterday as its just so stressful trying to pack our things but also constantly cleaning for the viewings.

After reading this thread I realise I'm only going through half of the process too as we haven't sold, at the moment we're just moving.

I'm sad that this thread is as solicitor bashing thread. I'm not a conveyancer but I am a property solicitor and was looking for a bit of support in buying my first home, not o read solicitor bashing stuff Sad

I haven't bashed. Our solicitors are fantastic. However, we are paying a professional fee for a professional service. About £5k I think for the sale and purchase, possibly a bit more. You get what you pay for.

I'm not bashing either! My post pointed out how the failed buyers solicitor was dreadfully poor (blanantly lying which cannot be misconstrued or just down to my personal opinions), but mine was good, drafting a new contract in the fastest time anyone could remember - quite the opposite of bashing! I'm super pleased with my solicitor; she's been nothing but supportive and helpful....

I can't really see solicitor bashing either, only alabaster's comment on one solicitor acting poorly, which is fair enough if they have!
My solicitor's bloody good too. Don't even want to count up how much we'll have paid him at the end of one sale and three purchases! assuming that the third one is finally successful that is. We're just waiting and waiting now for the survey to be done, surveyor reckoned end of next week is the earliest they could book in.
