Can a primary school withdrawn an offer for FS1 placed after 2 months of the acceptance and initial payment done?

Hello everyone, I would like to get your thoughts about a situation happening right now.
My son had been accepted in a private School in Dubai (British Curriculum) for the next academic year (FS1). Initial tuition fees have been paid.
After 1-2 months from this acceptance and in line with KHDA requirement related to the new cutoff date, we have received now a confirmation that the offer has been withdrawn, and the school cannot offer him a place anymore because they are at full capacity for the FS2 Year.
In addition to this frustrating event, we know that many children that were in the same situation have been accepted from same current class in the nursery.
I would appreciate in getting any possible guidance regarding this matter.

It would be a contractual thing, not specifically a primary school thing, and a contact based on Dubai law. You would need to carefully read any terms and conditions you were presented with concerning offers/acceptances and initial payments.

Have they said they will give you your money back?

Yes, they will refund the initial amount. But now we are in a situation where 3 of our kids in September will be in 3 different schools, which is something I still cannot believe.
