Hi, I am a committee member of a local playgroup and we are shortly to have a change of management in that the committee are stepping down and the school is taking over. We have been members of the PreSchool Learning Association and the constitution we purchased from them states that we have to give all our assets to the next local PLA member should the playgroup close.

Do we really need to do this?

Has anyone else had an experience such as this?
The playgroup will still be running in the same place with the same children and staff - it seems that this would disadvantage the children in my opinion.
Any advice welcome.

Could the preschool make a donation to the school before the handover?

I'd assume that was intended for the case when the preschool closed down completely, so the committee didn't pocket the assets. You're not closing you're having a change of management. Presumably you need to do some technical stuff to get this to happen in practice and close down the committee. You could always vote to amend the constitution at that point.

Unless someone from within the committee is trying to challenge it I doubt anyone would notice anyway.

Good idea to make a donation but also as you say, its not closing down completely and so we should be able to keep the assets - I have posted this in the legal section also so will see if any response
