Should we be getting a EYFS profile?

A little background...

DS2 is almost 5. He should have gone into a Reception class last September but didn't get a school place (that's a whole other thread...). As he is still entitled to EYFS funding, he has been going to his old playgroup 5 mornings a week.
At this moment in time, there is still no school place for DS2 and if a place does not come up over the summer, I will be Home-Educating him until a space in a suitable Year 1 class is available.

My problem is that my son's keyworker has been told by her supervisors not to complete a report on DS2. This is the summative, end-of EYFS report/profile thing that all the other children are getting and it's being passed on to their new teachers.
Surely we are entitled to have a final report on DS2? Especially as he will be going to school at some point?
Not sure if the report is statutory, like the end of KS results/reports are.

Hi I am almost positive they are statutory to be completed at the end of the reception year, however as he is at nursery and not in full time reception I am not sure if there is some sort of loop hole? Sorry not much help

I found this on the ARA for 2013...

? all EYFS providers, including maintained schools, non-maintained schools, independent schools, children?s centres, Free Schools, academies and childcare providers registered by Ofsted on the Early Years register, where the child spends the majority of their time between 8.00am and 6.00pm, must complete the EYFS profile assessment; and
? all foundation years providers must complete an EYFS profile for each child during the academic year they reach the age of five (for most children this is the Reception Year in primary school). The EYFS profile is intended to provide parents and carers, practitioners and teachers with a well-rounded picture of the child?s development. It is also intended to help Year 1 teachers to plan an effective and appropriate curriculum for a smooth transition to Key Stage 1.

So although DS is not in a Reception class, by still being at the playgroup are they by default "foundation year providers"?

Have you tried posting on the Primary Education page about finding a school place/EYFS profile as some very knowledgeable admissions type people on there/EYFS teachers who may be able to help.

I'm fairly sure there is no loophole and they are obliged to do the end of Foundation Stage assessment.

In the blurb Profile posted it says they must complete it if the child spends the majority of their time between 8am and 6pm there, so if he is doing less than 6 hours per day I guess they are not required to.

I would go in with a 'would you do this as a favour' attitude and ask if they will complete one to help him settle in when you do find a school place.
