2nd job on Maternity leave?

Hi everyone,

I’m currently pregnant and will be going on maternity leave at the end of the year. I have my main job and also work part time in a pub one shift a week.

I want to take a full year leave from my main job. My question is, during my last 3 unpaid months once SMP is finished.. could I work my one shift a week in the pub again? I know I can’t do it while receiving SMP and wondering about the unpaid months.

thank you x

Yes, if you aren’t being paid you can work anywhere x

Yes, as long as you were employed by your second employer during your qualifying week you can work for them whilst on maternity leave from the other employer without it affecting your leave or pay.

is the pub job under a contract?

I am not sure on this one OP. Pretty sure in my last job, the maternity policy stated that you couldn’t work elsewhere whilst on Mat leave. Might be worth checking with your main employer? (You can do 10 keeping in touch days that you are paid for)

I don’t know the full terms and conditions but two jobs= two SMP payments so that might help. And if you don’t get SMP from both you may be entitled to MA from one.

Sorry that last point is wrong of no SMP from either then MA from one

My main employer knows I do shifts and they don’t mind but not checked the maternity policy

Can'tvyou just ask for cash in hand if you aren't sure.

If you were already employed in your second job then you could also qualify for maternity leave and pay from them and take it at different times to your main job. You can go back to work in your 2nd job during your leave without affecting your maternity pay from your main employer. If you earned enough per week you could also qualify for SMP from your second employer. Think minimum per week is £125 to get SMP.

This isn't true. You can only get MA if you dont qualify for SMP and can't get both payments at the same time. You can get 2 lots of SMP if you qualify in both jobs though

Yes I corrected the statement underneath

If you have received your smp entitlement and haven’t yet gone back to work and are not being paid you can work anywhere weather a new or old contract
