EWC/Enhanced maternity pay wording - help

Hi mums,

Yesterday I found I was unexpectedly pregnant with 2nd child (1st child is almost three). Husband and I are in two minds about what to do as we weren’t planning to have another for various reasons - I was between contraceptions when our silly accident occurred!

Something that will clinch it is whether I can get enhanced maternity pay at work. I was made redundant in my last job during pregnancy (it was a FTC) and was on SMP, it really affected my MH and I stupidly decided to find another job in my depressive state and ended up starting it when my son was 5 months old. I am left with a lot of guilt and trauma from that period which is one of the reasons why we were ‘one and done’.

I’m a bit frazzled so can anyone help figuring out if I’d get enhanced maternity? So I started my current role on 4th Dec 2023. Dtd on 6th May so likely due late Jan to mid Feb, although online calculators are taking it from my last period so are saying 30th Jan.

Work maternity policy says:

‘The employee will be eligible to receive enhanced maternitypay if they have been continuously employed by us during the 12 month period ending with the 11th week prior to EWC’.

I feel like I would just make it?! Thoughts?!

I’m by no means an expert but your EWC goes from Sunday to sat. So your 30th jan is a Thurs so your EWC starts from 26th jan. 11 weeks prior works out 10th nov so I think you’d just miss it (but this is just my understanding and may be wrong)

PP above is correct and if your due date took you to mid February you’d be looking at end of November instead so you’d miss the cut off ever so slightly, not sure if your HR would take into account how close it could be so sorry it’s not better news there.

hopefully the dates line up for you as you’d be very close to getting it if it was due date on end of February

I think you would have had to be employed for a year by 11th November, so unfortunately you're about 3 weeks short.
