I'm currently from the UK and live in Costa Rica and I'm pregnant. My employer does not know I'm working abroad and they have asked me for a MAT B1 form to allow me claim SMP. I cannot travel to UK, is there a way around this?

@BoneshakerBike last time I checked Costa Rica wasn’t in the EU or EEA or indeed actually in the continent of Europe

Read the link- other countries are eligible if NI is being paid

And what does this have to do with Costa Rica?

It clearly says;

If you work in a different country, you can still get SMP as long as your employer pays UK National Insurance contributions for you.
Talk to your employer about claiming SMP.

@BoneshakerBike but OPs employer doesn't know she's in another country. So she's behaving fraudulently. She won't get a MATB1 form as she hasn't received medical care here ergo she won't get SMP or mat leave

OP it seems you're only 11 weeks along? In which case I guess you could speedily permanently relocate to the UK in time for 12 week scan and all your other mat appointments and avoid your employer finding out you've spent the last year in Costa Rica. But it'll have to be a permanent move.

Well she could go back after the birth and spend maternity leave there. But is she has the baby in CR she will qualify to permanent residency. You can't have you cake and eat it!
