MAT B1 form. Help!

jessm44 · 16/04/2024 11:33

I'm currently from the UK and live in Costa Rica and I'm pregnant. My employer does not know I'm working abroad and they have asked me for a MAT B1 form to allow me claim SMP. I cannot travel to UK, is there a way around this?

OP posts:
Are your children’s vaccines up to date?
YouveGotAFastCar · 16/04/2024 12:25

If you haven't lived here for a year, you're not going to get maternity care or be eligible for SMP.

You're going to have to tell your employer that you're not eligible for maternity care, somehow.

berksandbeyond · 16/04/2024 12:27

Also Costa Rica has signed The Hague convention so if this is real then I suggest you get your arse back on a plane to the UK ASAP

JumpstartMondays · 16/04/2024 12:30

How to tell the OP they're not eligible without directly telling them they're not eligible 😂

OneMoreTime23 · 16/04/2024 12:32

There are huge tax implications for UK employers with employees in other countries.

This is dismissal territory, OP.

What if I came back to me UK to see the doctor?

You're not resident in the UK so not entitled to NHS care. You'll need proof of pregnancy date from a UK hospital to get a mat B1 so would have to hang around a while to get an appt, scan etc.

littlemousebigcheese · 16/04/2024 12:44

It says the OP pays tax in the uk so surely she would be entitled to maternity pay? Her main issue is that her employers don't know she's not in the country

Yoyooo · 16/04/2024 12:46

I need more details in this OP I am invested.

How did this come about! How do you get away with it. What job do you do?

CoCoBeeBee · 16/04/2024 12:47

How far along are you OP sorry if I've missed this...

Yeah but she’s also committing tax fraud and likely to be sacked so swings and roundabouts

Commenting just so I see the OP's updates on this shitshow of a situation (entirely of her own making!).

Also invested to know how on earth has ended up in this situation and how employer doesn't know she is working abroad!!

And tax fraud, so there's that too

Aside from anything else, the time difference must be causing issues!

Exactly what I was going to say.

Redruby2020 · 16/04/2024 14:06

I have lived here for 1 year now. I'm sure I asked a question about MAT B1 form, I didn't ask for your opinion nor do I care, thanks

Wow so rude.
So you are asking to in a way commit fraud then, as in get something you are not entitled to.

Statutory Maternity Pay (SMP)If you work for a UK employer in the European Economic Area (EEA) or Switzerland, you may get SMP as long as you’re eligible for it.
Find out if you can get Statutory Maternity Pay in the EEA or Switzerland.
If you work in a different country, you can still get SMP as long as your employer pays UK National Insurance contributions for you.

Benefits and pensions for UK nationals in the EU, EEA or Switzerland

This guidance explains the rights of UK nationals in the EU, the European Economic Area (EEA) or Switzerland to benefits and pensions.

@BoneshakerBike last time I checked Costa Rica wasn’t in the EU or EEA or indeed actually in the continent of Europe

Sounds like a hell of a gap year based on your other thread too 🤣

Can you share a link. I'm in the shitty app so can't AS. This sounds like just the read for my break 😀

Mumoftwo2022 · 16/04/2024 14:26

In a word no you won’t get a MATB1 form. You get that from a midwife and if you are in the uk you’ve got no chance. Good luck telling your boss!

And what does this have to do with Costa Rica?

Whatifthehokeycokey · 16/04/2024 16:18

How pregnant are you? Might be time to move back e.g. in with a parent and get back into the system.

PickledPurplePickle · 16/04/2024 16:33

MATB1 comes from midwife. If you’re not living in the UK you’re not entitled

Your employer needs to be told if you’re not living in the UK as this has tax implications for them, as well as potential issues with data being shared outside of the UK. Not telling them would be gross
misconduct in a lot of companies

anonhop · 16/04/2024 17:03

Do you have more details, OP?
Is it a kind of "gap year", staying with friends scenario or have you properly moved out there?
